Penelitian ini bertujuan untuk mengaji bagaimana respons fatwa Majelis Ulama Indonesia (MUI) tentang aborsi dan penggunaan vaksin meningitis setelah berinteraksi dengan perubahan sosial yang terjadi di masyarakat dan sejauh mana pengaruhnya terhadap keputusan fatwa. Penelitian ini termasuk penelitian kepustakaan (library research) dengan menggunakan sumber data primer berupa fatwa MUI tentang Aborsi Nomor 07 tahun 1983 tentang Kependudukan, Kesehatan dan Pembangunan. Fatwa MUI Nomor 25 tahun 2000, Nomor 35 tahun 2005 tentang Aborsi serta Fatwa MUI tahun 2009 dan 2010 tentang Penggunaan Vaksin Meningitis bagi Jamaah Haji dan Umrah. Sedangkan untuk sumber data sekunder berupa buku, majalah, jurnal dan dokumen lain yang berkaitan dengan penelitian ini. Penelitian ini termasuk dalam kategori penelitian normatif. Temuan penelitian ini adalah: pertama, fatwa MUI tentang aborsi dan penggunaan vaksin meningitis cenderung dinamis terlihat dari respons MUI yang baik terhadap perubahan sosial masyarakat di Indonesia. Hal ini berdasarkan pada kenyataan bahwa MUI tercatat telah mengeluarkan fatwa tentang aborsi sebanyak tiga kali selama kurun waktu 22 tahun dan fatwa tentang penggunaan vaksin meningitis sebanyak dua kali hanya dalam kurun waktu satu tahun. Ketiga fatwa tentang aborsi tersebut yaitu fatwa Nomor 7 tahun 1983 merupakan respons MUI yang bertujuan untuk mendukung program pemerintah supaya umat Islam terlibat dalam kemajuan pembangunan nasional. Fatwa Nomor 25 tahun 2000 yang merupakan pengukuhan fatwa sebelumnya dan juga sebagai bentuk respons terhadap pro dan kontra yang terjadi di masyarakat tentang hukum melakukan aborsi sebelum peniupan roh. Sedangkan fatwa Nomor 35 tahun 2005 adalah respons terhadap banyaknya praktik aborsi yang dilakukan masyarakat tanpa memperhatikan tuntunan agama dan juga pertanyaan kebolehan melakukan aborsi dalam kondisi-kondisi tertentu. Selanjutnya 2 fatwa yang menyangkut mengenai penggunaan vaksin meningitis yaitu, Fatwa Nomor 05 tahun 2009 yang merupakan respons MUI terhadap ancaman penyakit meningitis dan juga kewajiban yang ditetapkan pemerintah Arab Saudi yang mewajibkan semua orang yang akan mengunjungi negara tersebut untuk melakukan vaksin. Fatwa Nomor 06 tahun 2010 adalah bentuk respons MUI terhadap permohonan fatwa dari beberapa produsen yang memproduksi vaksin meningitis tersebut. Kedua, perbedaan kondisi lingkungan sosial cukup mempengaruhi keputusan fatwa MUI tentang aborsi dan penggunaan vaksin meningitis ini, hal ini terlihat dari subtansi fatwa yang cukup dinamis. Fatwa aborsi pada tahun 2000 yang mengharamkan melakukan aborsi baik sebelum ataupun sesudah nafk al-ruh merupakan pengukuhan fatwa sebelumnya pada tahun 1983. Namun pada fatwa aborsi tahun 2005 MUI menambahkan poin baru yang berhubungan dengan alasan yang membolehkan aborsi. Alasan tersebut adalah keadaan hajat dimana janin yang dikandung dideteksi cacat genetik dan juga kehamilan akibat perkosaan. Selanjutnya tentang fatwa penggunaan vaksin meningitis pada tahun 2010 merupakan pencabutan kebolehan menggunakan vaksin haram karena kebutuhan mendesak yang dinyatakan pada fatwa tahun 2009. Fatwa tahun 2010 ini memiliki tambahan baru yakni jenis vaksin yang halal digunakan. Metodologi yang digunakan MUI dalam menetapkan fatwa-fatwa tersebut adalah dengan menggunakan tarjih yaitu memperhatikan pendapat para ulama terdahulu kemudian menyimpulkan yang paling kuat argumentasinya dan juga mempertimbangkan keadaan darurat yang berdasarkan pada konsep maslahat. Penelitian ini mendukung pernyataan para peneliti sebelumnya seperti Linant de Ballefonds (1955), Khalid Mas’ud (1973), Subhi Mahmassani (1981) dan Wael B. Hallaq (1997) yang menyatakan hukum Islam bersifat dinamis, elastis, yaitu bisa beradaptasi dengan perubahan sosial. Fleksibilitas hukum Islam dalam praktek dan penekanan pada ijtihad (Independent Legal Rasioning) cukup menunjukkan bahwa hukum Islam bisa beradaptasi dengan perubahan sosial. Penelitian ini menolak pernyataan sejumlah tokoh seperti Josep Schacht (1965), Noel J. Coulson (1964) dan J.N.D Anderson (1959) yang berpendapat hukum Islam adalah abadi, statis, final dan mutlak yang karenanya tidak bisa beradaptasi dengan perubahan sosial.

This volume examines the important question of whether or not international human rights and Islamic law are compatible. It asks whether Muslim States can comply with international human rights law whilst adhering to Islamic law. The traditional arguments on this subject are examined and responded to from both international human rights and Islamic legal perspectives. The volume engages international human rights law in theoretical dialogue with Islamic law, facilitating an evaluation of the human rights policy of modern Muslim States. International Human Rights and Islamic Law formulates a synthesis between these two extremes, and argues that although there are differences of scope and application, there is no fundamental incompatibility between these two bodies of law. Baderin argues that their differences could be better addressed if the concept of human rights were positively established from within the themes of Islamic law, rather than by imposing it upon Islamic law as an alien concept. Each article of the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights, as well as relevant articles of the Convention on the Elimination of All Forms of Discrimination against Women are analysed in the light of Islamic law. The volume concludes that it is possible to harmonise the differences between international human rights law and Islamic law through the adoption of the 'margin of appreciation' doctrine by international human rights treaty bodies and the utilization of the Islamic law doctrines of 'maqâsid al-sharî'ah' (the overall objective of Sharî'ah) and 'maslahah' (welfare) by Muslim States in their interpretation and application of Islamic law respectively. Baderin asserts that Islamic law can serve as an important vehicle for the guarantee and enforcement of international human rights law in the Muslim world, and the volume concludes with recommendations to that effect.
