In this volume, Karl Ameriks explores 'Kantian subjects' in three senses. In Part I, he first clarifies the most distinctive features-such as freedom and autonomy-of Kant's notion of what it is for us to be a subject. Other chapters then consider related 'subjects' that are basic topics in other parts of Kant's philosophy, such as his notions of necessity and history. Part II examines the ways in which many of us, as 'late modern,' have been highly influenced by Kant's philosophy and its indirect effect on our self-conception through successive generations of post-Kantians, such as Hegel and Schelling, and early Romantic writers such as Hölderlin, Schlegel, and Novalis, thus making us 'Kantian subjects' in a new historical sense. By defending the fundamentals of Kant's ethics in reaction to some of the latest scholarship in the opening chapters, Ameriks offers an extensive argument that Hölderlin expresses a valuable philosophical position that is much closer to Kant than has generally been recognized. He also argues that it was necessary for Kant's position to be supplemented by the new conception, introduced by the post-Kantians, of philosophy as fundamentally historical, and that this conception has had a growing influence on the most interesting strands of Anglophone as well as Continental philosophy.

Normative Subjects alludes to the fields of morality and law, as well as to the entities, self and collectivity, addressed by these clusters of norms. The book explores connections between the two. The conception of self that informs this book is the joint product of two multifaceted philosophical strands, the constructivist and the hermeneutical. Various schools of thought view human beings as self creating: by pursuing our goals and promoting our projects, and so while abiding by the various norms that guide us in these endeavors, we also determine human identity. The result is an emphasis on a reciprocal relationship between law and morality on the one side and the composition and boundaries of the self on the other. In what medium does this self creation take place, and who exactly is the "we" engaged in it? The answer suggested by the hermeneutical tradition provides the book with its second main theme. Like plays and novels, human beings are constituted by meaning, and these meanings vary in their level of abstraction. Self creation is a matter of fixing and elaborating these meanings at different levels of abstraction: the individual, the collective, and the universal. A key implication of this picture, explored in the book, is a conception of human dignity as accruing to us qua authors of the values and norms by which we define our selves individually and collectively.

Developing work in the theories of action and explanation, Eldridge argues that moral and political philosophers require accounts of what is historically possible, while historians require rough philosophical understandings of ideals that merit reasonable endorsement. Both Immanuel Kant and Walter Benjamin recognize this fact. Each sees a special place for religious consciousness and critical practice in the articulation and revision of ideals that are to have cultural effect, but they differ sharply in the forms of religious-philosophical understanding, cultural criticism, and political practice that they favor. Kant defends a liberal, reformist, Protestant stance, emphasizing the importance of liberty, individual rights, and democratic institutions. His fullest picture of movement toward a moral culture appears in Religion within the Bounds of Mere Reason, where he describes conjecturally the emergence of an ethical commonwealth. Benjamin defends a politics of improvisatory alertness and consciousness-raising that is suspicious of progress and liberal reform. He practices a form of modernist, materialist criticism that is strongly rooted in his encounters with Kant, Hölderlin, and Goethe. His fullest, finished picture of this critical practice appears in One-Way Street, where he traces the continuing force of unsatisfied desires. By drawing on both Kant and Benjamin, Eldridge hopes to avoid both moralism (standing on sharply specified normative commitments at all costs) and waywardness (rejecting all settled commitments). And in doing so, he seeks to make better sense of the commitment-forming, commitment-revising, anxious, reflective and sometimes grownup acculturated human subjects we are.

A reappraisal on the emphasis on duty in Immanuel Kant's ethics is long overdue. Marcia W. Baron evaluates and for the most part defends Kantian ethics against two frequent criticisms: that duty plays too large a role, leaving no room for the supererogatory; and that Kant places too much value on acting from duty. The author first argues that Kant's distinction between perfect and imperfect duties provides a plausible and intriguing alternative to contemporary approaches to charity, self-sacrifice, heroism, and saintliness. She probes the differences between the supererogationist and the Kantian, exploring the motivation between the former's position and bringing to light sharply divided views on the nature of moral constraint and excellence. Baron then confronts problems associated with Kant's account of moral motivation, she argues that the value that Kant attaches to acting from duty attaches primarily to governing ones conduct by a commitment to doing what morality asks. Thus understood, Kant's ethics steers clear of the most serious criticism. Of special interest is her discussion of overdetermination. The founding premise of this book is that the nimbus of prestige, which once surrounded the idea of justice, has now been dimmed to such a degree that it is no longer sufficient to secure the possibility of a good conscience for those who undertake, in good faith, to make the world a better place in the spheres of politics and law. The many decent human beings who have noticed and experienced this diminishment of justice’s prestige find themselves in a thoroughly disenchanted existential situation. For them, the attempt to do justice without the illusion of being grounded in something beyond the sheer facticity of their own performances is a distinctly ethical theme, which cries out to be investigated in its own right. Heeding the cry, this book asks and attempts to answer the following fundamental ethical question: is a life in the law – even one spent in the pursuit of justice – worth living, and if so, how can a disenchanted person come to bear the living of it without constantly having to engage in self-deception? If Nietzsche is right that living without illusions is impossible for human beings, then the most important ethical implication of this essentially anthropological fact goes far beyond the question of what illusions we ought to choose. It must also include the question of whether we should succumb to that most seductive and pernicious of all illusions: namely, the belief that exercising great care and responsibility in choosing our illusions – which we might then call our ‘principles of justice’ – excuses us ethically for what we do to others in their name. The culmination of a 10 year legal-philosophical project, this book will appeal to graduate students, scholars and curious non-academic intellectuals interested in continental philosophy, critical legal theory, postmodern theology, the philosophy of human rights and the study of individual ethics in the context of law.
