Keeping Hold Of Justice written by Jennifer Balint and has been published by University of Michigan Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-02-17 with Political Science categories.

Keeping Hold of Justice focuses on a select range of encounters between law and colonialism from the early nineteenth century to the present. It emphasizes the nature of colonialism as a distinctively structural injustice, one which becomes entrenched in the social, political, legal, and discursive structures of societies and thereby continues to affect people’s lives in the present. It charts, in particular, the role of law in both enabling and sustaining colonial injustice and in recognizing and redressing it. In so doing, the book seeks to demonstrate the possibilities for structural justice that still exist despite the enduring legacies and harms of colonialism. It puts forward that these possibilities can be found through collaborative methodologies and practices, such as those informing this book, that actively bring together different disciplines, peoples, temporalities, laws and ways of knowing. They reveal law not only as a source of colonial harm but also as a potential means of keeping hold of justice.

An Institutional Theory Of Law written by Peter Morton and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1998 with Institutions (Philosophy) categories.

Modern law is to be understood as comprising norms which are implicated in particular forms of life which -- animated by the modern values of individualism -- have emerged in democratic polities. Failure to understand the nature of such fundamental institutional forms as 'society' and 'state',and of the need to appraise the central institutions of the democractic polity against the demands of legitimacy, has had serious consequences for political and legal theory in recent times. In An Institutional Theory of Law, Morton provides a fundamental philosophical critique of the assumptions ofpositivist jurisprudence and an attack on the foundationalism of contemporary legal philosophy. His prime concern is to distinguish between the different fields of law -- penal, civil, and public -- taking as his starting point the careful analysis of the institutions in a democracy within whichlegal language and norms are generated. Offering an original, coherent and systematic exposition of law in society today, Peter Morton sheds new, important light on legal practices and relations through comparison with an ideal type of legal system. With this book, Peter Morton offers readers a major contribution to our understanding oflaw in society in the 1990s. As such it will be of great interest to scholars of legal theory, political science, and political constitution.

Virginia was a battleground state in the struggle to implement Brown v. Board of Education, with one of the South’s largest and strongest NAACP units fighting against a program of noncompliance crafted by the state’s political leaders. Keep On Keeping On offers a detailed examination of how African Americans and the NAACP in Virginia successfully pursued a legal agenda that provided new educational opportunities for the state’s black population in the face of fierce opposition from segregationists and the Democratic Party of Harry F. Byrd Sr. Keep On Keeping On is the first book to offer a comprehensive view of African Americans’ efforts to obtain racial equality in Virginia in the later twentieth century. Brian J. Daugherity considers the relationship between the various levels of the NAACP, the ideas and actions of other African American organizations, and the stances of Virginia’s political leaders, white liberals and moderates, and segregationists. In doing so, the author provides a better understanding of the connections between the actions of white political leaders and those of black civil rights activists working to bring about school desegregation. Blending social, legal, southern, and African American history, this book sheds new light on the civil rights movement and white resistance to civil rights in Virginia and the South.

The War On Sex written by Chad Denton and has been published by McFarland this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-11-05 with Social Science categories.

From earliest times, sex has fascinated and repulsed society in equal measure. In an effort to untangle Western society's complex relationship with the realities of sex, this provocative volume explores the ways in which governments, religious leaders and cultures in Europe tried to regulate sex and sexuality throughout history. From the sacred texts of ancient Israel to the slums of 19th century Britain, this book explores political, legal and cultural controls on consensual sex and the individuals and movements that resisted them. Topics range from prostitution and homosexuality to marriage, contraception and abortion. While traditional narrative holds that Europe alternated between sexual freedom and oppression through the Victorian age, this work reveals that the real story of how sex was regulated--and how people defied regulation--is not so clear cut.
