Insya Allah, buku ini__sebagai salah satu sumbangsih penulis bagi reformasi hukum di Indonesia__akan sampai di hadapan para pembaca. Semula substansi buku ini berasal dari disertasi penulis, berjudul: Tanggung Jawab Pidana Korporasi dalam Tindak Pidana Perlindungan Konsumen di Indonesia: Analisis tentang Perkara-perkara Tindak Pidana Perlindungan Konsumen. Disertasi ini telah dipertahankan dalam Sidang Terbuka Senat Akademik Universitas Indonesia pada Sabtu, pukul 13.00—15.30 WIB, 19 Juni 2010 di Kampus Universitas Indonesia (UI), Depok. Puji syukur penulis panjatkan kepada Allah SWT atas segala izin dan karunia yang diberikan-Nya kepada penulis untuk menyelesaikan tugas akademik penelitian/penulisan disertasi ini. Untuk keperluan penerbitan, judul disertasi tersebut telah disesuaikan tanpa mengurangi substansi revisi disertasi yang dilakukan penulis, terakhir setelah sidang terbuka tersebut. Inspirasi topik dan judul buku tersebut berasal dari Bab IX B buku penulis Perlindungan Konsumen dan Instrumen-instrumen Hukumnya (Cet. ke-1, 1999/2000; Cet. ke-2, 2003; dan Cet. ke-3, 2009). Diilhami uraian dalam bab tersebut, fokus perhatian buku ini membahas pertanggungjawaban pidana korporasi dari sisi pengaturan dan praktiknya dalam hukum perlindungan konsumen di Indonesia. Jadi, fokus perhatian penulis terletak pada pelaku tindak pidana korporasi, bukan pada perilaku yang dirumuskan dalam berbagai tindak pidana perlindungan konsumen di Indonesia. Sejak tahun 1955 sesudah berlakunya Undang-undang Tindak Pidana Ekonomi 1955 (Undang-Undang No. 7/DRT/1955; UUTPE 1955), hingga saat ini tidak satu pun korporasi dijatuhi pidana. Sementara itu Undang-Undang Perlindungan Konsumen 1999 (Undang-Undang No. 8 Tahun 1999; UUPK 1999) juga membebani pertanggungjawaban pidana kepada korporasi atas tindak pidana (laku pidana) perlindungan konsumen. Akan tetapi hal yang sama masih juga terjadi dalam masa rezim perlindungan konsumen. Sebanyak 36 kasus tindak pidana perlindungan konsumen telah dikaji dengan menggunakan desain penelitian (hukum) normatif. Tidak ada korporasi yang dijatuhi pidana. Isu kontroversial tersebut tidak membuat penulis kecewa. Argumentasi-argumentasi pengadilan terkait ke-36 kasus terse- but dicermati dengan teliti. Hasilnya, bahwa sejumlah argumentasi memberi ruang yang lebih luas bagi pertanggungjawaban pidana korporasi. Sehubungan dengan hal ini, pengadilan masih tetap berperan memberikan argumentasi hukum tentang teori pelaku fungsional dalam tindak pidana.
