Drawing on data from a cross-section of postcolonial nations across the world and on a detailed case-study of Nigeria, this book examines the experience of recreating law and justice in postcolonial societies. The author's definition of postcolonial societies includes countries that have emerged from external colonial rule, such as Nigeria and India as well as societies that have overcome internal dominations, such as Afghanistan and Iraq. Suggesting that restructuring a system of law and justice must involve a consideration of the traditions, customs and native laws of a society as well as the official, often foreign rules, this volume examines how ethnically complex nations resolve disputes, whether criminal or civil, through a combination of formal and informal social control systems. This book is unique in its concern with how the average citizens of a postcolonial society can play more active parts in their nation's law and justice, and how modern and increasingly urban societies can learn from indigenous peoples and institutions, which are more informal in their approaches to problem-solving. This ethnography analyses labour relations within the export-oriented cut flower industry at Lake Naivasha in Kenya. Though this agro-industry has attracted critical attention from journalists and non-governmental organizations, this book is the first comprehensive, social scientific analysis of the industry’s labour arrangements and production processes. Gerda Kuiper here interprets the work on the farms as ‘agro-industrial labour’: a labour system characterized by high levels of discipline and a strict rhythm of work, due to the demands posed by a highly perishable agricultural product. This framework enables the author to draw on insights from a wide range of anthropological and sociological studies on (agro-)industrial wage labour around the globe. This mixed-methods approach, deployed alongside rich ethnographic detail, allows the author to center the flower farm workers in her analysis.

The trend for international engagement in post-conflict reconstruction has produced a host of best-practice postulates on topics such as local involvement in decision-making, accountability for past atrocities, sensitivity to context, and the construction of democratic institutions of governance. International law has potential relevance for many of these themes, yet the question of how the implementation of best-practice policy recommendations might be affected by international law remains under-examined. This book offers a fuller understanding of the role of international law in the practice of post-conflict reconstruction.
