What does the concept of the best interests of the child mean in practice? How should it be interpreted and applied? This publication sheds lights on different aspects of this concept. The concept of the best interests of child, as stated in Article 3.1 of the United Nations Convention on the Rights of the Child, has caused many controversies and debates amongst policy makers, experts and practitioners. Although central to a child’s full enjoyment of his or her rights, the meaning of the concept in practice and how it should be interpreted and applied, is still part of today’s debate. The Belgian Authorities and the Council of Europe organised on 9 and 10 December 2014 a conference on “The best interests of the child - A dialogue between theory and practice” to provide an opportunity for actors involved in decisions that have an impact on children’s lives to share knowledge and enhance the understanding of the concept of the child’s best interest. Featuring in this publication are the 21 different viewpoints presented during the conference on the concept of the best interests of the child. They are divided into four chapters namely those presenting general reflections of the concept; assessing, determining and monitoring best interests; using the concept in different environments; and understanding the concept in family affairs. All viewpoints agree on the fact that there is no comprehensive definition of the concept, and that its vagueness has resulted in practical difficulties for those trying to apply it. Some suggest that the best interest should therefore only be used when necessary, appropriate and feasible for advancing children’s rights, whereas others see the flexibility of the concept as its strong point. Through their different interpretations and analysis, this publication offers a solid contribution to the overall understanding of the concept of the best interests of child, necessary to improving and safeguarding children’s rights overall.

Gezinsondersteuning kan gezien worden als een gedeelde opvoedingsverantwoordelijkheid, maar soms is het ook een zaak van verdeelde opvoedingsverantwoordelijkheid. Dan is de opvoedingsondersteuning een manier om ouders te sturen. Over deze kwesties in theorie, in beleid en in praktijk gaat dit boek. En telkens houdt het ons voor ogen dat het gezin als dusdanig al lang dood is. In de plaats komt een veelheid aan samenlevingsvormen die we al dan niet gezinnen noemen. Daarbij mogen we ook de pleegzorg en adoptiegezinnen niet vergeten. De rode draad is dat de Gezinspedagogiek 2.0 een gezinspedagogiek is die breekt met enkele eeuwen van goede raad geven en die begint met luisteren.

Que signifie le concept de l'intérêt supérieur de l'enfant dans la pratique? Comment devrait-il être interprété et appliqué? Cette publication éclaire différents aspects de ce concept. Le principe d’intérêt supérieur de l’enfant, tel qu’énoncé à l’article 3, paragraphe 1, de la Convention internationale des droits de l’enfant (CIDE) des Nations Unies fait l’objet de moult débats et controverses parmi les décideurs politiques, les spécialistes et les professionnels. Essentiel pour la jouissance effective des droits de l’enfant, il demeure difficile à définir, à interpréter et à appliquer. Les autorités belges et le Conseil de l’Europe ont organisé, les 9 et 10 décembre 2014, une conférence intitulée « L’intérêt supérieur de l’enfant : un dialogue entre théorie et pratique » pour favoriser l’échange de savoirs entre les acteurs dont les décisions influent sur la vie des enfants et afin de mieux appréhender le principe d’intérêt supérieur de l’enfant. Ce recueil de 21 points de vue présentés lors de la conférence est divisé en quatre chapitres, dont le premier est consacré à des considérations d’ordre général, le deuxième à l’évaluation, la détermination et le suivi de l’intérêt supérieur de l’enfant, le troisième à l’application de ce principe dans divers contextes et le dernier à l’intérêt supérieur de l’enfant dans les affaires familiales. Tous les auteurs s’accordent à reconnaître qu’il n’existe pas de définition exhaustive de l’intérêt supérieur de l’enfant et que l’imprécision d’une telle notion rend difficile son application. Aussi certains suggèrent-ils de l’invoquer uniquement lorsque cela s’avère nécessaire, opportun et réalisable pour promouvoir les droits de l’enfant. D’autres considèrent que la souplesse du principe en fait justement son atout. Par sa diversité d’éclairages, d’interprétations et d’analyses, cet ouvrage contribue à mieux appréhender la notion d’intérêt supérieur de l’enfant, point de départ pour renforcer et protéger les droits de l’enfant en général.
