This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.

The legal position of convicted offenders is complex, as are the social consequences that can result from a criminal conviction. After they have served their sentences, custodial or not, convicted offenders often continue to be subject to numerous restrictions, in many cases indefinitely, due to their criminal conviction. In short, criminal convictions can have adverse legal consequences that may affect convicted offenders in several aspects of their lives. In turn, these legal consequences can have broader social consequences. Legal consequences are often not formally part of the criminal law, but are regulated by different areas of law, such as administrative law, constitutional law, labour law, civil law, and immigration law. For this reason, they are often obscured from judges as well as from defendants and their legal representatives in the courtroom. The breadth, severity and longevity and often hidden nature of these restrictions raises the question of whether offenders' fundamental rights are sufficiently protected. This book explores the nature and extent of the legal consequences of criminal convictions in Europe, Australia and the USA. It addresses the following questions: What legal consequences can a criminal conviction have? How do these consequences affect convicted offenders? And how can and should these consequences be limited by law?

This volume provides insights on how recruitment patterns develop for two related types of criminal networks: organized crime and terrorism. It specifically explores the social, situational, psychological, and economic drivers of recruitment. Two different sanctioning systems are applicable to young adult offenders in Germany: juvenile criminal law and adult criminal law. The present study provides an overview of the various sanctions applied to these adolescents aged between 18 and 20 and of their reconvictions during an observation period. Based on data from the German Federal Central Criminal Register (Bundeszentral- und Erziehungsregister), the study covers all convictions and juvenile diversional measures in a specific reference year. This data set allows a detailed examination of the applied sanctions and measures, the proportion of juvenile and adult criminal law, and the reconviction rate differentiated by gender, age, offence and other variables. The empirical analysis also addresses regional differences in sanctioning and examines, if juvenile criminal law is “milder” and/or more effective than adult criminal law – questions that play an essential role in the debate on suitable sanctions for young adults.

Einbruchsdelikte, insbesondere Wohnungseinbrüche, standen in den vergangenen Jahren vermehrt im Mittelpunkt öffentlichen Interesses. Dieser Deliktsbereich ist für das Sicherheitsgefühl der Bevölkerung und damit auch für die Kriminalpolitik von wesentlicher Bedeutung. Die vom Gesetzgeber im Jahr 2017 vorgenommene Strafschärfung des Wohnungseinbruchs hat eine breite Diskussion in Kriminalpolitik und Strafrechtsdogmatik erfahren. Diese Untersuchung befasst sich aus empirischer Sicht mit dem Deliktsbereich der Einbruchsdelikte, der Sanktionierung der Täter sowie deren Vorbelastung und Rückfälligkeit, indem ein bundesweiter Datensatz aus dem Bundeszentralregister ausgewertet wird. Dabei werden mit dem zugrundeliegenden Datenmaterial auch die kriminellen Karrieren von Einbrechern prospektiv über einen neunjährigen Rückfallzeitraum und - soweit keine Tilgungen erfolgten - über einen unbefristeten Zeitraum retrospektiv analysiert.

On 22 June 2018 the 12th Colloquium on Criminal Law and Justice took place in Göttingen, followed by a farewell symposium for Jörg-Martin Jehle on the next day. In the same year, Jörg-Martin Jehle retired after 22 years of work at the Georg August University of Göttingen. This event coincided with the 50th anniversary of criminology in Göttingen, the topic of the 12th Colloquium. This book is based on these occasions, but also contains some additional articles in honor of Jörg-Martin Jehle from close companions, who for different reasons were not able to participate in the two events.
