Hiernach widmet sich Rolf Bolwin der Problematik der künstlerischen Verantwortung von Kollektiven am Beispiel der Documenta 22. Den Abschluss des Tagungsbandes bildet das Referat von Sandrine Giroud zu Fragen der Beschlagnahmung und Einziehung von Kulturgut durch Anwendung von internationalen Sanktionen und durch internationale Strafrechtshilfe.

Felix Uhlmann setzt sich mit der faktischen Macht der Cancel Culture auseinander und unterbreitet eine rechtliche Verortung. 2019 wurden die Mechanismen der Third Party Guarantees erläutert; nun analysiert Anne Laure Bandle die rechtliche Einbettung der Third Party Guarantees in der Welt der Auktionen. Markus Müller-Chen analysiert das Bedürfnis nach Einführung einer Unabhängigen Kommission für während des Nationalsozialismus gestohlene resp. verfolgungsbedingt entzogene Kulturgüter. Den Band beschliesst Pascal Grolimund mit einer Darstellung der rechtlichen Möglichkeiten und Risiken der Kunstversicherung.

De politionele aanpak van kunstcriminaliteit is in België en Nederland een onderbelicht thema. Nochtans genereert dit fenomeen criminele opbrengsten en is de culturele schade aanzienlijk. Kunstcriminaliteit – of criminaliteit tegen cultureel erfgoed – uit zich in verschillende transnationale vormen: diefstal, plundering en illegale handel in cultuurgoederen, vernieling van cultureel erfgoed tijdens militaire conflicten of maatschappelijke onrust, iconoclasme, vervalsing en fraude, en witwassen van crimineel geld. De kunstmarkt is per definitie geglobaliseerd en wordt gedragen door actoren die werken met internationale tussenpersonen. Ze is matig gereguleerd, moeilijk te controleren en discretie en geheimhouding heersen. De collusie tussen de criminele onder- en bovenwereld noodzaakt een internationale politionele en beleidsmatige visie.

The illicit traffic in cultural objects is a grave concern to the general public and international community. The resulting cultural damage fuels debates on how best to regulate the trade in cultural objects and inform legal responses at all levels for the protection of movable cultural heritage. Treaties concerning the treatment of cultural objects during peacetime and war represent some of the earliest multilateral initiatives on cultural heritage in the modern era. They also remain some of the most deeply contested, representing shifting fault lines within the international community. Authored by leading scholars and practitioners from around the world, this Commentary is the first to cover the two leading multilateral treaties on movable cultural heritage in one volume: the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property adopted by UNESCO in 1970 and the Convention on Stolen or Illegally Exported Cultural Objects adopted by UNIDROIT in 1995. This Commentary is designed to be the authoritative text for academics, lawyers, policymakers, and diplomats on the protection and regulation of cultural objects. Encompassing both public and private international law rules on the trade in cultural objects, it provides a detailed historical and thematic overview. Drawing on the travaux preparatoires and intergovernmental and state practice over the last half century, the Commentary provides an article-by-article analysis of the interpretation and application of these treaties. The treatment of cultural colonial objects is one of the most debated questions of our time. Calls for a new international cultural order go back to decolonization. However, for decades, the issue has been treated as a matter of comity or been reduced to a Shakespearean dilemma: to return or not to return. Confronting Colonial Objects seeks to go beyond these classic dichotomies and argues that contemporary practices are at a tipping point. The book shows that cultural takings were material to the colonial project throughout different periods and went far beyond looting. It presents micro histories and object biographies to trace recurring justifications and contestations of takings and returns while outlining the complicity of anthropology, racial science, and professional networks that enabled colonial collecting. The book demonstrates the dual role of law and cultural heritage regulation in facilitating colonial injustices and mobilizing resistance thereto. Drawing on the interplay between justice, ethics, and human rights, Stahn develops principles of relational cultural justice. He challenges the argument that takings were acceptable according to the standards of the time and outlines how future engagement requires a re-invention of knowledge systems and relations towards objects, including new forms of consent, provenance research, and partnership, and a re-thinking of the role of museums themselves. Following the life story and transformation of cultural objects, this book provides a fresh perspective on international law and colonial history that appeals to audiences across a variety of disciplines. In 1998, France was one of the 44 signatory states of the Washington Declaration. This study examines to what extent the Republic has fulfilled its obligations under this declaration by evaluating the extensive case practice. In contrast to other states, France has several legal instruments and procedures for the restitution of Nazi looted art: in addition to laws from the immediate post-war period that are still in force today, further regulations were created after 1998 - most recently the Restitution Act in 2023. The publication presents these legal instruments in a systematic manner and analyzes them from a comparative law perspective. In doing so, it also provides important points of reference for the restitution debate in Germany and other countries.
