Il lettore mi scuserà se divago, ma divagando posso poi motivare meglio, sul piano storico, il senso di questa riedizione. Dopo due anni di rinvii causa pandemia si è finalmente tenuto nel 2021 il tanto atteso concorso per 310 posti di magistrato ordinario, con la partecipazione alla prova scritta di 3.797 candidati, dei quali solo 220, cioè il 5,7 %, sono stati ammessi a quella orale. Uno dei commissari magistrati ha rilasciato una dichiarazione, quasi che la Commissione dovesse giustificarsi, se non addirittura scusarsi, assicurando che non c’era stata alcuna “severità predeterminata”, ma non era accettabile “una grande povertà argomentativa e linguistica”, con temi che ricalcavano “schemi preconfezionati, senza grande capacità di ragionamento, con scarsa originalità, poca consequenzialità e in alcuni casi errori marchiani di concetto, di diritto, di grammatica. Trovare candidati del concorso in magistratura che non sanno andare a capo è un problema molto serio, io l’ho imparato in terza elementare”, ha concluso il commissario. In altre parole i temi di coloro i quali ambiscono ad esercitare un potere che comporta pesanti ripercussioni, dirette o indirette, nella vita dei cittadini italiani, senza assumersi responsabilità alcuna, tanto meno ai fini della valutazione del merito e quindi della carriera, possono essere paragonati alla lettera dettata da Totò a Peppino nella memorabile scena del film Totò, Peppino e la malafemmina, compreso il punto a capo.
