Il volume “The best interests of the child tra Europa e America Latina” propone un’indagine insolita sulla categoria del superiore interesse del minore, ribaltando il metodo di osservazione “from pratice to theory”, in una chiave di analisi non esclusivamente di diritto pubblico e, soprattutto, in un quadro – avvertito dalla scienza giuridica come sempre più ineludibile - di diritto internazionale comparato. La ricerca, infatti, focalizza il confronto sui formanti delle due più attive Corti regionali, la Corte EDU e la Corte interamericana dei diritti umani. Attraverso di esso, si dà conto non solo degli aspetti strettamente normativi, ma anche delle contingenze fattuali delle singole fattispecie e delle diversità contestuali e procedurali in cui i due organi operano, presupposti indefettibili per rendere la comparazione più funzionale all’individuazione di un possibile “nucleo comune” del best interests of the child. Dalla lettura organica del materiale giurisprudenziale emerge, inoltre, il paradosso solo apparente delle divergenze interpretative, in quanto la presenza di ermeneutiche differenti – sia sul piano diacronico che sincronico – si rivela essere, prima ancora che assolutamente compatibile con la fisiologica essenza del principio, probabilmente persino necessaria per l’individuazione, case by case, del “bene” del singolo minore.

Il Comitato dei ministri del Consiglio d’Europa (COE) adotta questo Piano d'azione strategico relativo all’inclusione dei rom e dei travellers per il periodo 2020-2025. In esso sono tradotti gli obiettivi strategici del COE in materia di protezione e promozione dei diritti umani, democrazia e stato di diritto nel quadro politico per l'inclusione sociale e interculturale di rom e travellers in Europa. Il Piano fornisce un quadro flessibile e adattabile alle condizioni specifiche di ogni Paese, fungendo da tabella di marcia e strumento pratico per la progettazione, l'attuazione e l'adeguamento di rispettivi programmi e azioni. Gli obiettivi posti sono di promuovere e proteggere i diritti umani di rom e travellers, di combattere l'antiziganismo e la discriminazione e di favorire la loro inclusione nella società. Per quanto riguarda le azioni del COE, esse attingeranno alla giurisprudenza della Corte europea dei diritti dell'uomo e si baseranno sui risultati e sulle raccomandazioni degli organismi di controllo, in particolare quelle della Commissione europea contro il razzismo e l'intolleranza (ECRI), del Comitato europeo per i diritti sociali di la Carta sociale europea, del Comitato consultivo per la Convenzione quadro per la protezione delle minoranze nazionali e del Comitato di esperti della Carta europea per le lingue regionali o minoritarie.

This book deals with human rights in European criminal law after the Lisbon Treaty. Doubtless the Lisbon Treaty has constituted a milestone in the development of European criminal justice. Not only has the reform following the Treaty given binding force to the EU Charter of Fundamental Rights, but furthermore it has paved the way for unprecedented forms of supranational legislation. In this scenario, the enforcement of individual rights in criminal matters has become a core goal of EU legislation. Alongside these developments, new interactions between national and supranational jurisprudences have emerged, which have significantly contributed to a human rights-oriented approach to European criminal law. The book analyses the main developments of this complex phenomenon from an interdisciplinary perspective.
