L'Organisation pour l'harmonisation en Afrique du droit des affaires (OHADA) vise à garantir la sécurité juridique et judiciaire des opérateurs économiques, en mettant à la disposition des Etats membres des règles d'affaires harmonisées, simples et modernes. Le processus d'adhésion de la République démocratique du Congo (RDC) à cette organisation a atteint son point culminant le 13 juillet 2012, suite au dépôt des instruments d'adhésion auprès du gouvernement de l'Etat dépositaire du Traité de Port-Louis. C'est donc le 12 septembre 2012 que le droit de l'OHADA entra en vigueur en RDC, métamorphosant ainsi l'architecture du droit congolais des affaires. Cet ouvrage se propose d'analyser le processus de transformation auquel le régime juridique congolais des sociétés commerciales a été soumis, après l'entrée en vigueur du droit de l'OHADA, en général, et de l'Acte uniforme relatif au droit des sociétés commerciales et du groupement d'intérêt économique, en particulier. A travers l'analyse de l'effet de l'article 10 du Traité OHADA et de la jurisprudence de la Cour commune de justice et d'arbitrage y relative, les auteurs présentent la substance de l'Acte uniforme relatif au droit des sociétés commerciales et des groupements d'intérêt économique, mais aussi les dispositions de droit interne qui, bien que pouvant avoir le même objet, ne sont pas strictement identiques à cet Acte uniforme, et le complètent.
