Fotografie e videoriprese permeano la nostra quotidianità. Tale “molteplicità visiva” impone di interrogarci sulla possibilità di utilizzare l’informazione contenuta nelle immagini all’interno del procedimento penale, in assenza di una disciplina legislativa ad hoc. Riuscire a “vedere” e ri-vedere la dinamica di un reato è probabilmente la più grande tentazione per chi sia chiamato a formulare un giudizio sulla colpevolezza o meno dell’imputato. Il dato visivo può costituire, in questo percorso, una valida risorsa nella ricostruzione del fatto storico oggetto di reato, avendo l’indubbia capacità di rappresentare l’azione, la condotta o l’evento. Allo stesso tempo è innegabile, però, che nelle fotografie e nelle videoriprese ci siano anche molte “zone d’ombra”, che devono essere lette e decifrate. L’immagine non è, dunque, solo ciò che si vede, ma anche ciò che si nasconde fuori dalla cornice visiva. Il dato visivo mostra un’azione, ma non necessariamente dimostra la colpevolezza che è sempre lasciata al prudente apprezzamento del giudice.

La motivazione rafforzata del provvedimento rappresenta il precipitato tecnico ad oggi più evoluto dell’obbligo di reddere rationem. Si tratta di una metodica di giudizio e di giustificazione a tappe obbligate, forgiata a livello giurisprudenziale, che scompone il ragionamento dell’autorità in plurimi, ancorché non esclusivi, passaggi logici fondamentali. Tale tecnica valutativo motivativa, da un lato, contribuisce a rendere più trasparente la spiegazione delle ragioni decisorie e, dall’altro lato, assicura che tutti i profili argomentativi salienti della fattispecie in esame siano presi in considerazione prima della decisione. In questa prospettiva, la motivazione rafforzata concretizza l’interesse che, negli ultimi anni, l’intera comunità dei giuristi ha mostrato per il perfezionamento dell’obbligo motivazionale. Analizzando quello che è dunque uno dei temi del momento, il volume offre dapprima un inquadramento teorico dell’istituto, di cui vengono delineate le caratteristiche essenziali, dopo un previo collocamento nel contesto storico- giuridico di riferimento. Successivamente, del fenomeno in questione vengono declinate alcune esemplificative applicazioni tipiche, nell’ottica di stimolare riflessioni e approfondimenti ulteriori in materia e, soprattutto, al fine di agevolarne la gestione da parte degli operatori del diritto, vista la sua sempre maggior diffusione.

This book centres on Webcam Child Sex Tourism and the Sweetie Project initiated by the children’s rights organization Terre des Hommes in 2013 in response to the exponential increase of online child abuse. Webcam child sex tourism is a growing international problem, which not only encourages the abuse and sexual exploitation of children and provides easy access to child-abuse images, but which is also a crime involving a relatively low risk for offenders as live-streamed webcam performances leave few traces that law enforcement can use. Moreover, webcam child sex tourism often has a cross-border character, which leads to jurisdictional conflicts and makes it even harder to obtain evidence, launch investigations or prosecute suspects. Terre des Hommes set out to actively tackle webcam child sex tourism by employing a virtual 10-year old Philippine girl named Sweetie, a so-called chatbot, to identify offenders in chatrooms. Sweetie 1.0 could be deployed only if police officers participated in chats, and thus was limited in dealing with the large number of offenders. With this in mind, a more pro-active and preventive approach was adopted to tackle the issue. Sweetie 2.0 was developed with an automated chat function to track, identify and deter individuals using the internet to sexually abuse children. Using chatbots allows the monitoring of larger parts of the internet to locate and identify (potential) offenders, and to send them messages to warn of the legal consequences should they proceed further. But using artificial intelligence raises serious legal questions. For instance, is sexually interacting with a virtual child actually a criminal offence? How do rules of criminal procedure apply to Sweetie as investigative software? Does using Sweetie 2.0 constitute entrapment? This book, the outcome of a comparative law research initiative by Leiden University’s Center for Law and Digital Technologies (eLaw) and the Tilburg Institute for Law, Technology, and Society (TILT), addresses the application of substantive criminal law and criminal procedure to Sweetie 2.0 within various jurisdictions around the world.
