L'introduction de l'économie de marché en Europe de l'Est a mis les acteurs publics de la région devant des dilemmes importants : pour introduire la liberté de concurrence, suffit-il de s'appuyer sur le marché ou faut-il au contraire adopter les lois de concurrence ? Si l'adoption de telles lois est choisie, que doivent alors être leur contenu et la mécanique de leur mise en œuvre ? La région a répondu de manière presque unanime à la première question : la majorité des pays ont introduit des politiques de concurrence et, subséquemment, les lois de concurrence. Sur le contenu de ces lois, une ressemblance flagrante entre les pays de la région peut être observée : la majorité de ces lois sont influencées par le droit communautaire. Ceux qui ont résisté à cette influence sont les pays qui, bien que s'engageant juridiquement, à l'égard de l'UE, au rapprochement du droit national avec le droit communautaire, ne sont pas concernés par l'adhésion à l'UE – autrement dit, les pays qui ne sont pas partie à un engagement politique et économique prometteur. Cette étude analyse la mécanique de cette influence et les tendances identifiées dans la région en domaine de concurrence, mais qui ne sont pas sans intérêt pour tous les pays en transition à la recherche de solutions quant à la régulation publique de la concurrence et qui ne sont pas insensibles aux intérêts communautaires. Une question de plus est celle de savoir à quoi sert-il d'adopter les règles de concurrence si des institutions inappropriées peuvent annihiler les bénéfices de leur application ? D'un point de vue prospectif, l'étude a suggéré certaines pistes – d'autres doivent encore être identifiées – pour contourner cette problématique pragmatique.

Given the impact that successive court rulings have had on the organisation of the sports movement in the past 15 years, the autonomy of non-governmental sports organisations has become a highly topical concern in Europe. It is also closely related to the issue of governance, the subject of previous Council of Europe studies. The Enlarged Partial Agreement on Sport (EPAS) decided to explore the concept of autonomy in greater depth by studying the conceptual, political, legal, economic and psycho-sociological aspects of the subject. This study was carried out at the request of the EPAS by the Swiss Graduate School of Public Administration (IDHEAP) on the basis of a questionnaire sent to public authorities in charge of sport and to national and international umbrella sports organisations. In addition to an analysis of the data obtained, documents produced by public authorities and sports organisations on this emerging issue are presented. This study contributes to a better understanding of the concept of autonomy and offers a clear picture of the issues involved.
