Cette thèse tente de déterminer les ressorts de la légitimité des immunités parlementaires au sein du régime représentatif en examinant leurs fondements et régimes juridiques en France, en Angleterre et aux États-Unis. Elle remet en question la pertinence de la conception traditionnelle des immunités parlementaires qui postule une identité de fondement entre irresponsabilité et inviolabilité, pour en faire un ensemble homogène destiné à garantir l’indépendance des parlementaires et dont l’existence serait nécessaire au bon fonctionnement du régime représentatif. Une telle approche revient en réalité à reconnaître à l’inviolabilité un fondement qui est propre à l’irresponsabilité. Une démarche historique et comparatiste permet d’invalider l’hypothèse d’un lien logique et nécessaire entre immunités parlementaires et régime représentatif et montre qu’il convient de distinguer les deux modalités de l’immunité. Seule l’irresponsabilité apparaît comme un véritable corollaire du mandat représentatif car, en soustrayant l’exercice des fonctions parlementaires à l’appréciation d’un pouvoir concurrent, elle protége, du point de vue juridique, le libre exercice du mandat. Témoigne de l’importance de la protection, la relative uniformité des régimes juridiques des immunités ou privilèges qui, quel que soit le pays considéré, visent à soustraire le représentant aux conséquences des infractions commises dans l’exercice de ses fonctions. En revanche la quasi absence d’inviolabilité en droit anglais et américain illustre la capacité du régime représentatif à fonctionner de manière satisfaisante, tout en soumettant au droit commun les infractions détachables de l’exercice des fonctions parlementaires. Parce que le caractère représentatif du mandat permet à l’assemblée de fonctionner régulièrement, même en présence d’une Chambre incomplète, il ne saurait fonder l’existence d’une inviolabilité dont la vocation première est de garantir la présence, sinon effective du moins potentielle, des parlementaires en séance.
