L’opera analizza lo sviluppo della normativa europea per la protezione degli interessi finanziari dell’Unione, una materia che riguarda sia il diritto penale che il diritto extrapenale, di particolare interesse perché in essa, più che in altre, si è finora sviluppato il concetto di Unione Europea come “area comune di giustizia” Dopo una analisi della definizione della nozione di “interessi finanziari dell’Unione Europea”, ed un cenno alla composizione del bilancio dell’Unione, l’opera si divide in due parti: nella prima viene esaminata la normativa extrapenale dell’Unione Europea per proteggere il proprio bilancio, nella seconda la normativa penale. Sotto il primo profilo, si sottolineano gli strumenti di indagine che prima la Comunità e poi l’Unione avevano messo in campo per permettere di ravvisare le irregolarità nella gestione dei fondi europei o nella riscossione delle entrate, quali i c.d. “controlli sul posto” e la nascita di un vero e proprio ufficio investigativo, sebbene a livello amministrativo, quale è l’OLAF. Si analizza poi il quadro legale dell’OLAF e la sua potenzialità nella circolazione della prova all’Interno dell’Unione. Sotto il secondo aspetto, si illustra la nascita e lo sviluppo del diritto penale europeo, di cui quello per la lotta alla frode è componente essenziale, ripercorrendo le principali tappe di questo percorso, dalla Convenzione PIF e protocolli del 1995-1997 al Corpus Iuris, al ruolo decisivo della Corte di Giustizia, per finire con gli sviluppi più recenti, dopo il Trattato di Lisbona e nel nuovo quadro normativo da esso delineato: il ruolo degli artt. 82, 83 e 325 TFUE, la direttiva PIF, il regolamento sulla Procura Europea, con un accenno al notissimo “caso Taricco”.

This book explores the European Public Prosecutor’s Office (EPPO), the creation of which was approved in the Regulation adopted by the Justice and Home Affairs (JHA) Council on 12 October 2017. The EPPO will be an independent European prosecution office tasked with investigating and prosecuting those crimes defined in the recently adopted Regulation 2017/1371 on combating fraud against the Union’s financial interests by means of criminal law. As such, it will be a new actor on the EU landscape, governed by the principle of loyal cooperation with the national prosecuting authorities. This work clarifies some of the challenges that member states will have to face when dealing with a supranational prosecution authority. In addition, it provides guidelines on how to implement the present Regulation while respecting the fundamental rights of defendants in criminal proceedings. The book is of special interest in so far as the analysis and perspective of academics is completed with the contributions of legal experts who have either been involved in the negotiations to establish the European public prosecutor or will be closely linked, as public prosecutors, to the functioning of the future European public prosecutor’s office.
