Inadapte au monde moderne de l'innovation, le systeme international des brevets est entre dans une phase de declin. Ce declin est du principalement au fait qu'en depit de l'existence de leurs accords internationaux en la matiere, les Etats en sont venus a sortir du cadre du droit conventionnel des brevets (exemple du logiciel) et a adopter parfois de nouveaux textes (par exemple pour la protection des topographies de produits semi-conducteurs). Ce livre retrace les etapes qui ont conduit la situation actuelle. Il explique pourquoi et comment il est devenu urgent de moderniser et d'equilibrer le systeme international des brevets d'invention. Over the course of history, different legal instruments for protecting intellectual property have emerged. These instruments differ in their subject matter, extent of protection, and field of application, reflecting society's objective to balance the interests of creators and consumers for different types of intellectual works. These legal instruments are just one of the pieces that form a national system of intellectual property protection. Also crucial to the system's overall effectiveness are the institutions administering these instruments, the mechanisms available for enforcing IPRs, and the rules regarding the treatment of non-nationals. To address some of the issues concerning IPRs, this paper defines what they are and attempts to evaluate the relationship between the protection of intellectual property and economic activity in developing countries. It also summarizes the economic effects of IPRs in terms of creation and diffusion of knowledge and information; and market structure and prices. Furthermore, it discusses the reformation of IPRs regimes and makes recommendations for their administration and enforcement. This paper consolidates some of the research from the 'World Development Report 1998/1999: Knowledge for Development' and some contributions made at an Internet-moderated conference conducted by the Bank's TechNet program. It will be of interest to governments, investors, and international organizations.

A la fois public et prive, interne et international, le droit de l'environnement s'est affirme en tant que branche du droit autonome et la diversite de sources et des techniques qu'il utilise est saluee comme un avantage. Mais les instruments juridiques mis en place sont-ils adequats ? La mise enoeuvre du droit de l'environnement, lequel navigue entre soft law et instruments plus classiques, est souvent problematique. La question des sanctions reste peu exploree. Le probleme de la reparation du dommage ecologique pur n'est qu'une illustration de ses difficultes. On pense aussi a la question des sanctions en droit communautaire ou en droit penal ou encore a l'effectivite des droits fondamentaux lies a l'environnement. Ce constat incite a poser la question de l'efficacite du droit de l'environnement. Le droit de l'environnement permet-il d'atteindre les objectifs qu'il s'est fixe ? Le colloque qui s'est tenu a l'Universite d'Orleans le 15 octobre 2009, s'est propose d'aborder cette question essentielle a travers les differents aspects du droit de l'environnement, interne, communautaire ou international, prive ou public. Les interventions, redigees par des specialistes de ces questions, font un bilan et proposent des ameliorations tendant a une plus grande efficacite de cette branche du droit qui a en charge l'avenir de l'humanite.
