Jusqu'a une epoque encore recente le droit de l'environnement etait un droit jeune, dont l'autonomie en tant que branche du droit suscitait des doutes et dont l'empirisme et la dispersion attiraient la critique. Pourtant, aujourd'hui on ne peut que constater son developpement spectaculaire. La protection de l'environnement inspire toutes les politiques publiques et les normes qui y concourent sont de plus en plus nombreuses et variees. A la fois public et prive, interne et international, le droit de l'environnement s'est affirme en tant que branche du droit autonome et la diversite de sources et des techniques qu'il utilise est saluee comme un avantage. Mais les instruments juridiques mis en place sont-ils adequats ? La mise enoeuvre du droit de l'environnement, lequel navigue entre soft law et instruments plus classiques, est souvent problematique. La question des sanctions reste peu exploree. Le probleme de la reparation du dommage ecologique pur n'est qu'une illustration de ses difficultes. On pense aussi a la question des sanctions en droit communautaire ou en droit penal ou encore a l'effectivite des droits fondamentaux lies a l'environnement. Ce constat incite a poser la question de l'efficacite du droit de l'environnement. Le droit de l'environnement permet-il d'atteindre les objectifs qu'il s'est fixe ? Le colloque qui s'est tenu a l'Universite d'Orleans le 15 octobre 2009, s'est propose d'aborder cette question essentielle a travers les differents aspects du droit de l'environnement, interne, communautaire ou international, prive ou public. Les interventions, redigees par des specialistes de ces questions, font un bilan et proposent des ameliorations tendant a une plus grande efficacite de cette branche du droit qui a en charge l'avenir de l'humanite.

This Handbook of European Environment and Climate Law is the 2nd edition of the work previously titled Handbook of European Environment Law. It is associated with the Traité de droit européen de l’environnement et du climat and the Manuel de droit européen de l’environnement et du climat, both in the French language and published in the same collection, and with which it shares a same structure. The Traité provides a more in-depth approach, with further historic, policy and caselaw considerations, and more complete references. The introduction in the book’s title of the climate dimension, while it was already quite present in the previous edition, is testimony to its growing importance absent a dedicated EU policy and corresponding legislative basis. Climate law is covered in its many occurrences along the work, its specificities noted, and their consequences recognized, especially with respect to the international background which brings about novel legal interventions, an upheaval of classical approaches, through the creation of a new governance for the implementation of the Paris Agreement and of the resulting EU legislation. The recurring changes in the many and diverse environmental legislations are also of course presented in context, including in light of the growing importance of circular economy and the proposal of a European Green Deal. This book focuses on how public and private international law address civil liability for transboundary pollution. In public international law, civil liability treaties promote the implementation of minimum procedural standards in domestic tort law. This approach implicitly relies on private international law to facilitate civil litigation against transboundary polluters. Yet this connection remains poorly understood. Filling the gap, this book engages in a meaningful dialogue between the two areas and explores how domestic private international law can reflect the policies developed in international environmental law. It begins with an investigation of civil liability in international environmental law. It then identifies preferable rules of civil jurisdiction, foreign judgments and choice of law for environmental damage, using Canadian private international law as a case study and making extensive references to European law. Liability for transboundary pollution is a contentious issue of the law, both in scholarship and practice: international lawyers both private and public as well as environmental lawyers will welcome this important work.
