This book provides an essential and critical overview of the most significant issues concerning the domestication of international criminal law, in particular with regard to the implementation of the ICC Statute. It discusses the most recent proposals for reform of the German Code of Crimes under International Law, the "Völkerstrafgesetzbuch", 20 years after its entering into force and introduces the project for an Italian code of international crimes drafted by the Committee of experts established in 2022 by the Ministry of Justice. Following the adoption of the ICC Statute, many States, including Germany with the "Völkerstrafgesetzbuch", introduced specific legislation to incorporate international criminal law into their domestic legal systems and a considerable number of them have been investigating and prosecuting war crimes, crimes against humanity, genocide, and even aggression ever since. Twenty-five years later, however, the process is not completed as other countries, like Italy, are still working on adopting provisions on international crimes. This book opens with a broad overview of the different approaches of the domestication of international criminal law, with a specific focus on the German and the Italian systems. After an assessment of the prerequisites for the domestic implementation of international criminal law, also from a constitutional law perspective, each chapter offers an in-depth analysis of a specific issue, such as: the definition of international crimes (genocide and crimes against humanity, war crimes and aggression); the applicability of and exceptions to the general principles of domestic criminal law; the regulation of individual criminal responsibility; sanctions and sentencing; as well as procedural aspects related to immunities, jurisdiction and prosecutorial discretion. The strong academic perspective of many authors is complemented by an equally strong practitioner perspective of the others, provided by legal scholars in the highest positions in international and national judicial institutions, resulting in a well-informed and critical appraisal of the most recent developments overall in the international criminal justice system. L’impiego di sanzioni di tipo ‘mirato’ o ‘intelligente’ ha caratterizzato l’azione del Consiglio di sicurezza delle Nazioni Unite nei primi due decenni del ventunesimo secolo. Un aspetto poco considerato riguarda l’esistenza di diverse stratificazioni di misure sanzionatorie rispetto ad una stessa situazione, in cui le organizzazioni regionali giocano un ruolo sempre crescente nel far fronte a minacce alla pace e alla sicurezza. L’interazione tra sanzioni a carattere universale e regionale si situa tra due poli: da un lato, una dinamica di tipo sussidiario, che vede le organizzazioni regionali come un prolungamento decentrato del sistema onusiano, dall’altro una dinamica di tipo competitivo, in cui non si escludono situazioni di tensione. Il libro, sulla base di una ricostruzione della prassi anche del continente africano, individua tre diversi modelli di relazione, a seconda che l’organizzazione regionale svolga un ruolo nella fase di attuazione delle sanzioni delle Nazioni Unite, oppure applichi contestualmente misure sanzionatorie nei confronti dei membri, oppure imponga misure restrittive nei confronti di terzi in assenza di un’azione da parte del Consiglio di sicurezza. Una ricognizione del dato normativo resta fondamentale sia per individuare quali siano gli strumenti giuridici dell’eventuale coordinamento tra l’ONU e le organizzazioni regionali, che non si limitano al Capitolo VIII della Carta, sia per verificare se vi sia stata un’evoluzione verso un approccio cooperativo rispetto alla tutela di interessi generali – come il mantenimento della pace e della sicurezza – nel senso anche dell’esistenza di una divisione del lavoro tra dimensione universale e regionale.

As of September 2017, the United Nations alone deployed 110,000 uniformed personnel from 122 countries in fifteen peacekeeping operations worldwide. Soldiers in these missions are important actors who not only have considerable responsibility for implementing peace and stability operations but also have a concomitant influence on their goals and impact. Yet we know surprisingly little about the factors that prompt soldiers' behavior. Despite being deployed on the same mission under similar conditions, various national contingents display significant, systematic differences in their actions on the ground. In Military Cultures in Peace and Stability Operations, Chiara Ruffa challenges the widely held assumption that military contingents, regardless of their origins, implement mandates in a similar manner. She argues instead that military culture—the set of attitudes, values, and beliefs instilled into an army and transmitted across generations of those in uniform —influences how soldiers behave at the tactical level. When soldiers are abroad, they are usually deployed as units, and when a military unit deploys, its military culture goes with it. By investigating where military culture comes from, Ruffa demonstrates why military units conduct themselves the way they do. Between 2007 and 2014, Ruffa was embedded in French and Italian units deployed under comparable circumstances in two different kinds of peace and stability operations: the United Nations Interim Force in Lebanon and the NATO mission in Afghanistan. Based on hundreds of interviews, she finds that while French units prioritized patrolling and the display of high levels of protection and force—such as body armor and weaponry—Italian units placed greater emphasis on delivering humanitarian aid. She concludes that civil-military relations and societal beliefs about the use of force in the units' home country have an impact on the military culture overseas, soldiers' perceptions and behavior, and, ultimately, consequences for their ability to keep the peace.
