La distribution pharmaceutique est la partie stratégique la plus sensible de la supply chain du médicament. Des évolutions majeures préfigurent une recomposition en profondeur des systèmes de distribution du médicament en France : volonté de Bruxelles de lever le monopole officinal français, développement des ventes directes, libéralisation du circuit officinal en Europe, harmonisation progressive des marchés pharmaceutiques en Europe, volonté croissante des industriels de verrouiller leur approvisionnement des officines. Les sociétés de répartition pharmaceutique full liners ont dû faire face à ces changements. Pour cela, elles ont dû faire évoluer leur cœur de métier en réalisant une intégration verticale et horizontale des autres métiers du médicament : de la réalisation de chaînes de pharmacies à la création ou au rachat de dépositaires short liners, etc...

What are public health services? Countries across Europe understand what they are or what they should include differently. This study describes the experiences of nine countries detailing the ways they have opted to organize and finance public health services and train and employ their public health workforce. It covers England France Germany Italy the Netherlands Slovenia Sweden Poland and the Republic of Moldova and aims to give insights into current practice that will support decision-makers in their efforts to strengthen public health capacities and services. Each country chapter captures the historical background of public health services and the context in which they operate; sets out the main organizational structures; assesses the sources of public health financing and how it is allocated; explains the training and employment of the public health workforce; and analyses existing frameworks for quality and performance assessment. The study reveals a wide range of experience and variation across Europe and clearly illustrates two fundamentally different approaches to public health services: integration with curative health services (as in Slovenia or Sweden) or organization and provision through a separate parallel structure (Republic of Moldova). The case studies explore the context that explain this divergence and its implications. This study is the result of close collaboration between the European Observatory on Health Systems and Policies and the WHO Regional Office for Europe Division of Health Systems and Public Health. Le patient et ses droits sont de plus en plus fréquemment évoqués par les institutions de l’Union européenne qui sont allées jusqu’à consacrer une directive à leur application en matière de soins de santé transfrontaliers. Le dynamisme insufflé par l’organisation de cette mobilité s’étend par ailleurs à l’ensemble des droits du patient puisque certaines dispositions sont assez générales pour intéresser la personne soignée dans son État d’affiliation. La reconnaissance de ces droits peut surprendre au premier abord tant ce thème est éloigné des préoccupations initiales des Communautés. L’objectif de cet ouvrage est donc de démontrer la contribution du droit de l’Union à la reconnaissance et à la mise en œuvre des droits du patient. En l’absence de compétence juridique spécifique, ce sont à la fois la voie des droits fondamentaux et celle du marché intérieur qui ont permis la reconnaissance des droits du patient. L’intérêt pour ce domaine est tel qu’il existe désormais un véritable foisonnement normatif, composé tant de sources déclaratoires qu’obligatoires, pouvant affecter l’accessibilité et l’intelligibilité des droits du patient. La mise en œuvre des droits révèle un double niveau de protection : la dimension transfrontalière des soins est particulièrement propice à la réalité des droits consubstantiels à cette situation, tandis que l’organisation est plus nuancée pour ceux sans lien spécifique avec la mobilité. Ce constat amène notamment à s’interroger sur l’amélioration de l’effectivité des droits. L’ensemble de cette analyse conduit in fine à une réflexion sur l’existence d’un statut juridique du patient, aboutissant à des propositions destinées à renforcer encore la place du patient en droit de l’Union et, par conséquent, le respect de ses droits. Cet ouvrage se destine à un public universitaire spécialisé en droit de la santé, mais également aux juristes (magistrats, avocats...), aux professionnels de la santé ainsi qu’à toute personne intéressée par les interactions entre le droit de la santé et le droit européen au sens large.
