L'hôpital, établissement de santé public, est conduit par son activité médicale à engager sa responsabilité pour les dommages qu'il cause à ses usagers. C'est tout d'abord, et pendant fort longtemps, la règle de l'irresponsabilité qui a prévalu. Le principe de responsabilité n'a en effet été admis que tardivement, au début du XXème siècle. C'est en 1935 exactement que naît cette responsabilité. Depuis cette époque elle bénéficie d'une reconnaissance certaine, croissant au rythme des progrès scientifiques. L'objectif apparaît rapidement comme la recherche de l'indemnisation des victimes. Le juge administratif crée dans un premier temps un clivage en distinguant l'acte paramédical de l'acte médical et en subordonnant, respectivement, à l'engagement de la responsabilité, la nécessité d'une faute simple et celle d'une faute lourde. En 1992, il abandonne cette dernière pour que lui soit substituée la notion unique de faute simple. Parallèlement, il dégage des systèmes de présemption de faute ainsi que des régimes de responsabilité sans faute. Le recul progressif de la faute constitue la trame de l'évolution de la responsabilité hospitalière. A ce jour, son rôle a considérablement diminué mais la faute reste maintenue dans son principe. Cet état de fait permet de présager que dans un avenir plus ou moins proche, elle s'effacera complètement au profit d'une responsabilité sans faute généralisée ; le Droit français en la matière dépasserait-il alors le Droit américain ?

The problem of the general political inclinations of the petite bourgeoisie, and especially its relationship to fascism, is one of the major questions currently facing historians dealing with European society in the past one hundred years. Independent artisans have at best been seen as an anachronism in the industrial age. Often, they are regarded as the social basis of the fascist movements of the 1920s and 30s because of their supposedly reactionary class interests. Unfortunately, such sweeping analyses--by both Marxists and non-Marxists alike--have been based largely on one case, that of Germany. It is France however, that has been considered the pre-eminent nation of the petit bourgeois, and fascism had only limited appeal there. This is the central question Zdatny addresses in this book as he examines the social and political history of the archetypical petite bourgeois, the self-employed craftsmen of France.

Man has been pondering for centuries over the basis of his own ethical and aesthetic values.
