Après la Seconde Guerre mondiale, et surtout depuis les années soixante-dix, les pouvoirs publics ont entrepris, en France, de nombreuses réformes pour améliorer les rapports entre l'administration et les administrés. Certaines sont destinées à aménager l'exercice de l'action administrative et, notamment, la mise en œuvre du pouvoir de décision unilatérale, par l'introduction d'un certain partage du pouvoir administratif au profit d'autorités administratives indépendantes et des administrés ou, plus modestement, par un renforcement de la protection procédurale de ces derniers. D'autres ont simplement pour objectif d'informer les administrés sur cette action. Enfin, des réformes visent à améliorer le règlement des litiges administratifs, soit par un développement des procédés de règlement non juridictionnel, soit par un accroissement de l'efficacité des recours juridictionnels. Mais cette évolution a une portée limitée sur la transformation du système administratif et, plus particulièrement, sur les rapports inégalitaires entre l'administration et les administrés, c'est-à-dire, d'une part, sur les droits et garanties accordés à ces derniers, d'autre part, sur les prérogatives dont dispose la première.
