Este libro analiza cómo la Constitución de 1978 ha querido poner las bases de un Poder Judicial que superara las tradicionales carencias que este ha presentado en España, en especial su dependencia del Poder Ejecutivo, la existencia de múltiples formas de erosionar y anular la independencia y el resto de garantías de los jueces, o la falta de medios que padeció durante muchas épocas. A partir del análisis de la norma constitucional, de su regulación de desarrollo y de la jurisprudencia más relevante, se quiere en estas páginas ofrecer un diagnóstico acerca del grado de éxito que ha logrado la Constitución en la consecución del propósito antes mencionado y de cuáles son los aspectos —no pocos ni menores— de la configuración de nuestro Poder Judicial en que persisten problemas, lo que plantea el reto de cómo abordarlos y darles solución, de manera que el servicio público de la justicia pueda dejar de ser percibido por la ciudadanía como un sector en el que los retrasos y las disfunciones parecen ser una seña de identidad. Para ello el libro se detiene en muy variados aspectos: los ejes de la regulación del Poder Judicial en nuestra actual Constitución y sus antecedentes; la necesaria apertura a la jurisprudencia del TJUE y del TEDH para la interpretación y aplicación de conceptos relevantes de nuestra norma constitucional; la organización jurisdiccional en España y sus principales características y problemas; el estatuto de los jueces en sus diferentes dimensiones; el gobierno del Poder Judicial y particularmente el CGPJ, órgano de funcionamiento problemático y cuya regulación legal muta constantemente; la relación entre el Poder Judicial y la estructura autonómica del Estado; el papel del Ministerio Fiscal y la participación ciudadana en la justicia. Una serie de elementos a través de cuyo análisis se quiere ofrecer al lector no sólo una explicación del punto al que hemos llegado, sino la identificación de los principales retos del Poder Judicial y las posibles formas de afrontarlos.
