Roma è città assolutamente “peculiare”, perché è al contempo sede del Capo della Chiesa cattolica e capitale dello Stato italiano. L’art. 1 cpv. del Concordato lateranense impegnava il Governo a preservare il “carattere sacro della Città Eterna, sede vescovile del Sommo Pontefice, centro del mondo cattolico e meta di pellegrinaggi”. Il volume traccia un quadro dell’interpretazione dottrinale e dei profili applicativi di tale norma dal 1929 al processo di revisione concordataria, per poi ricostruire la genesi e delineare l’esegesi dell’art. 2.4 dell’Accordo di Villa Madama del 1984, con il quale la Repubblica riconosce il “particolare significato” di Roma per la “cattolicità”. L’analisi dei problemi sottesi a tali disposizioni consente anche di mettere in luce alcune tendenze e linee evolutive del diritto e della politica ecclesiastica italiani dal fascismo alla Costituzione repubblicana del 1948, al nuovo Concordato del 1984, sino ai problemi attuali di una società divenuta multireligiosa e multiculturale.

Presentazione del card. Angelo De Donatis. La presente raccolta di studi esamina la preparazione, i contributi e la recezione del Vaticano II nelle diciassette diocesi laziali. Dopo un saggio sulla nascita e il cammino storico del “Lazio ecclesiastico” e della Conferenza episcopale regionale, costituitasi all’indomani del Concilio, il volume si suddivide in tre parti, dedicate rispettivamente alla diocesi di Roma, alle diocesi suburbicarie e alle altre diocesi della Regione. All’opera hanno collaborato ben ventuno studiosi di diversa competenza scientifica e impegno ecclesiale, alcuni dei quali personalmente coinvolti nel cammino – entusiasmante e difficile a un tempo – della recezione conciliare. Recezione che, come ha affermato pure papa Francesco, è per molti versi ancora agli inizi. Né potrebbe essere diversamente, trovandoci di fronte a un evento che ha profondamente riplasmato l’autocoscienza della Chiesa nel contesto di un mondo in rapida trasformazione. Il volume vuole appunto inserirsi nel cammino della recezione del Concilio, cioè della sua appropriazione vivente e creativa all’interno delle Chiese locali, partendo da quelle che, per singolare privilegio, costituiscono la Provincia romana, di cui il papa è «arcivescovo e metropolita». Pasquale Bua (1982), presbitero della diocesi di Latina, è professore straordinario di teologia dogmatica nell’Istituto Teologico Leoniano (Anagni) e professore invitato nella Facoltà di teologia della Pontificia Università Gregoriana. This book examines in detail both historical and current legal concepts of ‘religious cultural heritage’ within the context of the European continent. The latter group is primarily based on the variety of sacred cultural elements emanating from the different religious traditions of the peoples of Europe, which are deemed worthy of protection and preservation due to their outstanding value, in terms of their social, cultural and religious significance. In view of this, the study provides evidence of the European States’ active involvement with their sacred/cultural treasures, on the basis of the political and legal foundations of neutrality and pluralism. Furthermore, the book analyzes all relevant international legislative instruments (i.e. the plethora of EU, EC and UNESCO norms), as well as all major European legislative patterns, in light of their significance for the aforementioned aspects of pluralism and neutrality. The interdisciplinary references listed at the end of each chapter provide an additional incentive for further reading on the subject matter. The most important finding to emerge from the study is that there is a shared legal ethos in Europe that imposes a duty of appropriate care concerning the vast variety of sacred cultural goods and the religious cultural heritage in general, as an invaluable repository of European cultural capital. It also considers the sui generis nature of this capital: like any other type of asset, it may deteriorate or fade over time, necessitating investment in its preservation or refurbishment; nevertheless, like no other, this particular capital maintains a distinct cultural value, as it contains an additional characteristic of ‘sacredness’ expressed in the form of its ‘religious character,’ the latter being analyzed as a triptych of religious memory, religious aesthetics and religious beliefs.
