Nell'ultimo lustro si sono ricordati gli anniversari di quattro fondamentali passaggi che indelebilmente hanno segnato le terre dell’Alto Adriatico: il quarantennale della stipula del Trattato di Osimo (1975-2015), con cui si definisce giuridicamente il confine tra la Repubblica Italiana e la Repubblica Socialista Federale di Jugoslavia, il settantennio della firma del Trattato multilaterale di Parigi (1947-2017), con cui si pone fine al secondo conflitto mondiale, sancendo la perdita di sovranità da parte dell’Italia nelle Colonie e a Tenda e Briga in favore della Francia, ma soprattutto la cessione dell’Istria, con Zara e la Dalmazia, oltre a Fiume e a parte del Carso goriziano, a cui avrebbe dovuto seguire la formazione del cosiddetto Territorio Libero di Trieste sotto l’egida della nascente Organizzazione delle Nazioni Unite. Infine, il centenario dell’impresa dei legionari di Ronchi (1919-2019), con cui un manipolo di irredenti capitanati da Gabriele d’Annunzio vuole rivendicare la cosiddetta “vittoria mutilata” e il debole atteggiamento del Governo italiano, che politicamente non era riuscito a tradurre in maniera vantaggiosa le proprie affermazioni militari. La sorte di Fiume, Zara e di altre località adriatiche abitate da numerose comunità italiane segna gli umori di gran parte dell’opinione pubblica del Paese, nel frattempo messo in ginocchio da una forte crisi economica, sociale, a seguito della chiusura delle ostilità, e a cui si aggiunge quella sanitaria (la spagnola). Il generale malcontento da virtuale diviene concreto e tutta una serie di agitazioni, di vario colore politico, dilagano per tutta la Penisola. Contemporaneamente trova amalgama quella miscela di anticonformismo, irredentismo nazionalista e futurismo militarista che proprio nella spedizione dannunziana a Fiume segna una sintesi. In tale contesto, infatti, un manipolo di ufficiali, al comando di truppe che già da alcuni mesi sono in fervida attesa, il giorno 11 settembre 1919 parte alla volta di Fiume. L’Impresa dannunziana è lo specchio paradigmatico della contestuale complessità del primo dopoguerra europeo, caratterizzato da forti atipicità e da una compresenza di suggestioni assai difformi tra loro, dalle tendenze nazionaliste, alle evocazioni marxiste, senza tralasciare l’attrazione verso il sindacalismo rivoluzionario.

Il libro muove da una domanda che si impone con urgenza alle democrazie costituzionali: che rilievo giuridico attribuire alla diversità? La ricerca si confronta con questo tema concentrandosi su una precisa diversità, su una precisa rivendicazione: la richiesta di trattamento differenziato, su base culturale, che viene avanzata in giudizio da un individuo appartenente a un gruppo minoritario. Dopo aver delineato le coordinate teorico-concettuali del governo della differenza, l’analisi si concentra sul dato fenomenico, comparando le esperienze di Italia e Regno Unito, con l’obiettivo di individuare e comprendere i percorsi argomentativi degli organi giurisdizionali italiani e inglesi chiamati a pronunciarsi su quelle istanze. Nonostante le differenze di contesto normativo, politico e sociale, nonché di sistema e tradizione giuridica, l’indagine rivela come i giudici italiani e inglesi rispondano alla diversità rivendicata nelle aule giudiziarie con il medesimo approccio: evitando di affrontare la complessità che involge la diversità culturale manifestata all’interno del processo. In assenza di indicazioni provenienti dal piano legislativo, i giudici, privi della formazione necessaria e, tuttavia, obbligati a pronunciarsi sulle istanze loro presentate, si trovano disorientati e soli di fronte ai delicati, inediti, difficili dilemmi sollevati da questi casi. Diventa quindi necessario, e non più eludibile, elaborare e promuovere meccanismi che consentano di costruire una giurisdizione che tenga conto della dimensione culturale, capace di combinare in termini costituzionalmente orientati la garanzia dell’eguaglianza e della diversità con la tutela dei diritti dei più vulnerabili.

The Fiume Crisis recasts what we know about the birth of fascism, the rise of nationalism, and the fall of empire after World War I by telling the story of the three-year period when the Adriatic city of Fiume (today Rijeka, in Croatia) generated an international crisis. In 1919 the multicultural former Habsburg city was occupied by the paramilitary forces of the flamboyant poet-soldier Gabriele D’Annunzio, who aimed to annex the territory to Italy and became an inspiration to Mussolini. Many local Italians supported the effort, nurturing a standard tale of nationalist fanaticism. However, Dominique Kirchner Reill shows that practical realities, not nationalist ideals, were in the driver’s seat. Support for annexation was largely a result of the daily frustrations of life in a “ghost state” set adrift by the fall of the empire. D’Annunzio’s ideology and proto-fascist charisma notwithstanding, what the people of Fiume wanted was prosperity, which they associated with the autonomy they had enjoyed under Habsburg sovereignty. In these twilight years between the world that was and the world that would be, many across the former empire sought to restore the familiar forms of governance that once supported them.
