La Convención Internacional sobre los derechos de las personas con discapacidad fue aprobada por la Asamblea General de las Naciones Unidas el 13 de diciembre de 2006 y, desde su ratificación por nuestro país en el año 2008, forma parte de nuestro ordenamiento jurídico interno. Ello nos obliga, tal como dispone su artículo 4, a adoptar todas las medidas necesarias para hacer efectivos los derechos reconocidos en la misma, incluida la modificación o derogación de las normas pertinentes. En este proceso de adaptación de nuestro ordenamiento jurídico a las exigencias de la Convención se han dado ya pasos muy significativos a nivel estatal, como la promulgación de la Ley de adaptación normativa a la Convención (2011) y la Ley general de derechos de las personas con discapacidad y de su inclusión social (2013). Sin embargo, dado el sistema de reparto competencial establecido en nuestra Constitución, la acción de las Comunidades Autónomas se revela esencial en este asunto, en cuanto ostentan competencias en aspectos fundamentales para garantizar la efectividad de los derechos de las personas con discapacidad. En esta línea, este trabajo resulta pionero en el análisis del impacto de la Convención en el nivel de la legislación autonómica, concretamente la de la Comunidad Autónoma de Cantabria. Tras un análisis de las exigencias de la Convención, y una vez delimitadas las competencias de las diversas administraciones en las distintas materias que inciden en la garantía de los derechos de las personas con discapacidad —educación, sanidad, servicios sociales, empleo, ordenación del territorio y urbanismo, transportes, cultura y deporte, justicia, fiscalidad…—, el trabajo pone de manifiesto los déficits de la legislación autonómica y propugna medidas de reforma legislativa —casi noventa, que afectarían a veintiún leyes— para satisfacer aquellas exigencias. Adicionalmente, se propone la elaboración de una ley integral de garantía de los derechos de las personas con discapacidad que dote de unidad y coherencia al complejo tratamiento normativo de los derechos de estas personas.
