La Corte Suprema en escena es el primer estudio sistemático sobre el funcionamiento cotidiano de la más alta institución judicial en la Argentina, que desde hace varias décadas viene ganando visibilidad y generando controversias en el debate. ¿Quiénes acceden a la Corte, ese lugar que parece por definición alejado e impenetrable, y qué esperan de ella? ¿Cómo la perciben los jueces, los funcionarios o los empleados? Leticia Barrera expone la diversidad de actores en juego y el significado que tiene el tribunal para cada uno de ellos. Están quienes llevan a cabo acciones de protesta y consideran el espacio judicial como un foro para hacer oír sus reclamos; están los litigantes que padecen como una "falla" el proceso de toma de decisiones del tribunal; están los jueces y funcionarios que ven en él casi un "almacén de ramos generales" al que llega todo tipo de causas; están quienes lo experimentan como una práctica burocrática de creación de expedientes. Con una fina mirada etnográfica, la autora se interna en un territorio poco explorado hasta ahora. El espacio de la Corte es reconstruido a través de observaciones directas, entrevistas, recolección de imágenes y de historias de vida, poniendo énfasis en aquellos dispositivos que permiten vislumbrar el accionar del derecho en las prácticas y en las conciencias. Así, analiza el origen y el curso de los expedientes, atendiendo a las condiciones físicas en que se producen, se archivan y se manipulan los escritos, y explica también cuánto de escenificación y de montaje tienen las audiencias, y cómo esto deviene un instrumento más en la puja por imponer la agenda judicial. La originalidad del libro consiste en presentar el derecho no ya como un conjunto de verdades eternas sino como una actividad cultural que genera conocimiento y a la vez influye en la subjetividad y los vínculos de los participantes. Al tomar nota de las relaciones materiales y simbólicas que los instrumentos legales activan, el funcionamiento del máximo tribunal permite poner en evidencia las instancias propias de la creación del derecho: ese cruce en el que precisamente se define lo jurídico.

La crisis argentina de 2001 afectó la credibilidad del sistema político y golpeó también la legitimidad del máximo órgano del Poder Judicial. El proceso de renovación que se inició entonces implicó cambios en el elenco de jueces de la Corte Suprema así como una serie de reformas destinadas a reforzar el vínculo de la justicia con la ciudadanía y a difundir una nueva imagen de ese tribunal, para dotarlo de mayor transparencia de cara a la sociedad. Entre esas reformas, la práctica de las audiencias públicas fue el eslabón clave, porque prometía dar voz y visibilidad a los principales afectados por ciertas causas –la contaminación del Riachuelo, la sobrepoblación carcelaria, la Ley de Medios– y abrir el camino para una transformación institucional más amplia. En este libro, Miguel Benedetti y Jimena Sáenz ofrecen un estudio de las audiencias celebradas por el Máximo Tribunal entre 2004 y 2014, en el marco de un interrogante decisivo: ¿hasta qué punto esa práctica innovadora modificó el proceso de toma de decisiones judiciales? ¿Cuánto de su potencialidad como herramienta de democratización resultó atenuada por la discrecionalidad del tribunal, el excesivo formalismo o la preeminencia de las voces de los expertos técnicos? Desde un enfoque atento al detalle, el análisis no se circunscribe al "día en la Corte" sino que reconstruye todos los pasos del antes, el durante y el después: qué causas eligieron los jueces para convocar audiencias, cómo se desarrollaron y cómo impactaron sobre la decisión final del tribunal. Al volver visible el quehacer de la Corte, este trabajo echa luz sobre un universo de enorme riqueza. Y al explicar los riesgos que pueden derivarse del uso inapropiado de las audiencias, cuando no se regulan debidamente o cuando preservan márgenes de arbitrariedad, sienta las bases para discutir y mejorar con propuestas una práctica fundamental de democratización de la justicia y las instituciones.

Si todos los tribunales hablan a través de sus sentencias, cuando quien se expresa es la Corte Suprema de Justicia, sus palabras y argumentos resuenan con una fuerza particular: ubicada en la cima de la pirámide organizativa del Poder Judicial, sus fallos son un modelo para el resto de los tribunales y un mensaje para toda la sociedad. Sin embargo, escasean los trabajos que muestren el revés de la trama de las más altas decisiones judiciales, y son menos aún los que pueden hacerlo "desde adentro". Con la intención de llenar ese vacío, este libro original, basado en una sólida investigación y en la experiencia de primerísima mano de su autor, reconstruye el trayecto intelectual y fáctico que va desde que se plantea una demanda hasta la decisión que la resuelve. Rosatti, hoy presidente de la Corte Suprema, trabaja en estas páginas sobre casi cuatrocientos fallos que el tribunal dictó entre 1973 y 2002, un tiempo histórico convulso en el que se tomaron decisiones trascendentes que todavía hoy iluminan la jurisprudencia en nuestro país. Y a la vez se interna en el micromundo del cuarto piso del Palacio de Tribunales, sede de la Corte, para detectar la existencia y relevancia de rituales, personajes, tradiciones, reglamentos y oficinas que participan en la gestación de las sentencias. En ese recorrido, el autor examina, por ejemplo, qué casos recibe el tribunal y cuáles deja fuera de su competencia; describe el camino del expediente y el trabajo en las distintas áreas; recrea el circuito a través del cual los jueces discuten los temas, disienten y a veces cambian de opinión; examina la importancia de los tiempos en los que la Corte falla y se detiene con particular detalle en las características del lenguaje de las sentencias, sin esquivar la incómoda cuestión de la frecuente oscuridad de su redacción. Anota también algunas ideas alrededor de las discusiones que con frecuencia ganan la agenda pública: la creciente cantidad de causas que la Corte recibe, como si fuera un tribunal "corrector" de tribunales inferiores; la discusión sobre su cantidad de miembros; la siempre tensa relación entre justicia y política. Como lo son los fallos de la Corte, también esta investigación apunta a ser modélica en al menos un sentido: transparentar y socializar el funcionamiento del más alto tribunal quiere ser una invitación a democratizar el saber sobre el poder del Estado que, en nuestro sistema republicano, menos se conoce.
