Penser la démocratie sans demos implique de dénouer le lien solidement établi au XIXe siècle entre les concepts de démocratie et de souveraineté du peuple. A cela, la mondialisation contemporaine ne cesse de nous inciter. Le procès continu de démocratisation de l'Etat moderne a été rendu possible par l'individualisation du sujet de droit, elle-même résultat de la destruction des droits particuliers des sociétés d'Ancien Régime par l'action centralisatrice d'un pouvoir de type territorial. Mais, en s'imposant comme la seule instance garante des droits, l'Etat moderne a aussi nationalisé la citoyenneté. Or, il est certain qu'aujourd'hui l'érosion du monopole juridique et judiciaire de l'Etat s'accompagne d'une multiplication et d'une hétérogénéité croissantes des pouvoirs auxquels les individus peuvent et doivent s'adresser pour obtenir la reconnaissance et la garantie des droits qu'ils revendiquent. Cette situation nous fait obligation de dénationaliser la citoyenneté sans sacrifier pour autant cette forme spécifique de subjectivité politique qu'est l'individu sujet de droits, sans renoncer par conséquent aux ressources émancipatrices dont cette figure du sujet politique a fait la preuve au cours des deux derniers siècles.

In societies deeply shaped by neoliberal rationality, the common is increasingly invoked as the operative concept of practical struggles creating new forms of democratic governance. In a feat of analytic clarity, Dardot and Laval dissect and synthesize a vast repository on the concept of the commons, from the fields of philosophy, political theory, economics, legal theory, history, theology, and sociology. In this incisive book, André Duarte examines the health crisis resulting from the COVID-19 pandemic and the contemporary crisis of democracy. Reflecting on President Jair Bolsonaro’s misgovernment of Brazil, as evidenced by his political actions, speeches and omissions from March 2020 to September 2021, and using concepts like biopolitics, neoliberalism and necropolitics, Duarte proposes three interrelated hypotheses to demonstrate Bolsonaro's sharp distrust of democracy. First, that Bolsonaro’s rhetoric, actions and omissions during the first year and a half of the pandemic revealed a dangerous mixture of biopolitical, neoliberal and necropolitical governmentality strategies. Second, that the pandemic in Brazil intensified the damaging side-effects against democracy brought by neoliberalism and biopolitics, once the necropolitical vector assumed precedence. And third, that Bolsonaro’s political agenda is either to revoke the Brazilian democracy by violent means or to implement a façade democracy by slowly distorting it from within, blurring the differences between democracy and authoritarianism. Conceptualizing democracy as power of the demos and not exclusively as a political regime organized around a definite set of political institutions, Duarte argues that Bolsonaro's misgovernment of Brazil is related to his antidemocratic viewpoints. Pandemic and Crisis of Democracy is an important book for researchers, students, and anyone concerned about the dangers that surround the democratic experience in the contemporary world.

The gradual legal and political evolution of the European Union has not, thus far, been accompanied by the articulation or embrace of any substantive ideal of justice going beyond the founders' intent or the economic objectives of the market integration project. This absence arguably compromises the foundations of the EU legal and political system since the relationship between law and justice-a crucial question within any constitutional system-remains largely unaddressed. This edited volume brings together a number of concise contributions by leading academics and young scholars whose work addresses both legal and philosophical aspects of justice in the European context. The aim of the volume is to appraise the existence and nature of this deficit, its implications for Europe's future, and to begin a critical discussion about how it might be addressed. There have been many accounts of the EU as a story of constitutional evolution and a system of transnational governance, but few which pay sustained attention to the implications for justice. The EU today has moved beyond its initial and primary emphasis on the establishment of an Internal Market, as the growing importance of EU citizenship and social rights suggests. Yet, most legal analyses of the EU treaties and of EU case-law remain premised broadly on the assumption that EU law still largely serves the purpose of perfecting what is fundamentally a system of economic integration. The place to be occupied by the underlying substantive ideal of justice remains significantly underspecified or even vacant, creating a tension between the market-oriented foundation of the Union and the contemporary essence of its constitutional system. The relationship of law to justice is a core dimension of constitutional systems around the world, and the EU is arguably no different in this respect. The critical assessment of justice in the EU provided by the contributions to this book will help to create a fuller picture of the justice deficit in the EU, and at the same time open up an important new avenue of legal research of immediate importance.

The contemporary world is complex and is characterized by new normative challenges with regards to living conditions and political organization, both within the borders of sovereign states and globally. Such challenges require interdisciplinary analyses of a number of intertwined subjects. Varieties of Liberalism: Contemporary Challenges presents an important contribution to this pressing task. Relying on the cooperation of UiT The Arctic University of Norway research group Pluralism, Democracy and Justice, and the Civic Constellation project from Spain’s National Research Fund, the book is the outgrowth of the conference “Themes in Contemporary Ethics and Political Philosophy”, held in Tromsø in August 2012. An international array of scholars from universities in Brazil, France, Norway and Spain are brought together here, and combine normative reflections, conceptual analysis, case-studies and historical accounts. Philosophical liberalism provides the dominant perspective in contemporary political and social philosophy, and the majority of the authors take one version or another as their starting point, bringing together various different critical perspectives. Since it is crucial to sort out what an embracing of liberalism means and what a criticism of liberalism is directed at, the introduction of the book situates the chapters in relation to the disparate uses of ‘liberalism’. This book investigates the multifaceted conflicts of sovereignty in the recent crises in the European Union. Although the notion of sovereignty has been central in the contentious debates triggered by the recent crises in the European Union, it remains strikingly under-researched in political science. This book bridges this gap by providing both theoretical reflections and empirical analyses of today’s conflicts of sovereignty in the EU. More particularly, it investigates conflicts between four types of sovereignty. First, national sovereignty referring to the autonomy of the Westphalian Nation-State to rule on a territory delimited by borders; second, the supranational sovereignty acquired by the EU in a fragmentary fashion in a number of scattered internal and external policy fields; third, parliamentary sovereignty understood as the autonomy of parliaments (at the regional, national and European levels) to take part in the decision making process and control the executive in the name of the principles of election and representation; fourth, popular sovereignty whereby the body politic confers legitimacy to decision makers in a democratic system. Through an analysis of the various crises (rule of law, Brexit, migration, Eurozone crisis), the chapters look at how sovereignty is framed and contested by different types of actors, and how the strengthening or the weakening of certain types of sovereignty contribute to shape preferences regarding policies and governance structures in the multi-level EU. The chapters in this book were originally published as a special issue of the Journal of European Integration.
