Esos trabajos y libros se han organizado en este volumen, en las siguientes partes: En la Primera parte se recoge el texto del libro sobre La mentira como polItica de Estado que caracterizO las ejecutorias del gobierno del Presidente Hugo ChAvez durante su presidencia, la cual se extendiO desde 1999 hasta 2012, que ha sido la de mAs larga duraciOn en la historia constitucional del paIs, destacAndose las vicisitudes de sus anunciadas renuncias en 1999 y 2002; del referendo consultivo y revocatorio de su mandato entre 2002 y 2004; de la legItima conversiOn de la revocaciOn de su mandato en una "ratificaciOn" en el cargo; de su fracaso en la aprobaciOn de la fallida reforma constitucional de 2007; de la falsedad de sus faltas temporales y el ocultamiento de su falta absoluta entre 2011 y 2013; del falso e ilegItimo gobierno sin Presidente juramentado que se instalO en 2013; y del monumental desorden institucional que quedO como legado de su gobierno. En la Segunda parte se recoge el texto del libro sobre La ruina de la democracia, que saliO publicado en la vIspera de la elecciOn parlamentaria en Venezuela de diciembre de 2015, en el cual se planteO la necesidad que habIa de restablecer la democracia a travEs de la fuerza de la voluntad popular, estudiAndose diversos aspectos relativos al impacto de la destrucciOn de la democracia; al desprecio a la ConstituciOn con la creaciOn del Estado comunal; al secreto y la mentira como polItica de Estado; y a la masacre de la ConstituciOn cometida con los decretos de excepciOn; la condena a Leopoldo LOpez por el "delito de opiniOn," y a la criminalizaciOn del derecho a manifestar. En un Estado de derecho es inconcebible que el Juez Constitucional, quien deberia garantizar la supremacia de la Constitucion y sus valores, pueda llegar a ser el instrumento para al contrario garantizar la violacion impune de la Constitucion por los otros organos del Estado, para asegurar la destruccion del Estado de derecho o el desmantelamiento de la democracia, o incluso para convertirse en el instrumento para implementar y sostener un regimen autoritario. Y ello es precisamente lo que ha ocurrido en Venezuela, tal y como se analiza con todo detalle en esta obra de profesor Allan R. Brewer-Carias sobre Dictadura judicial y perversion del Estado de derecho. La Sala Constitucional y la destruccion de la democracia en Venezuela, donde analiza en particular lo ocurrido durante los primeros meses de 2016 luego del triunfo de la oposicion politica en las elecciones parlamentarias de diciembre de 2015, tiempo durante el cual en particular, el Juez Constitucional asumio la mision de impedir que la representacion popular encarnada en la nueva Asamblea Nacional pudiera ejercer sus funciones constitucionales. Y asi, sucesivamente mediante sentencias "constitucionales," fue impidiendole incluso hasta ejercer su poder de legislar sin el visto bueno previo del Poder Ejecutivo; desojandola de sus poderes de control politico sobre el gobierno y la Administracion Publica; impidiendole revisar sus propios actos, e incluso condenando y prohibiendo a la Asamblea el poder manifestar publicamente su voluntad politica mediante acuerdos. Ello ha sido obra de un Juez Constitucional sometido al control politico por parte del Poder Ejecutivo, que ha convertido a Sala Constitucional del Tribunal Supremo en el agente mas artero al servicio del autoritarismo, distorsionando la propia Jurisdiccion Constitucional que ha quedado convertida en el principal instrumento para destruir la democracia, dando origen a un perverso sistema de dictadura judicial, que funciona en el marco de la fachada de un "Estado de derecho," ahora ya totalmente vacio de contenido democratico. El contenido de este libro, sin duda puede considerarse como el mejor soporte a lo expresado por el Secretario General de la Organizacion de Estados Americanos Luis Almagro, en el Informe sobre las "alteraciones graves del orden constitucional y democratico" que experimenta Venezuela presentado y considerado por el Consejo Permanente de la misma con el respaldo de la gran mayoria de los paises del Continente en la sesion del 23 de junio de 2016, en el cual constato que existe "un Gobierno que ya no es democratico," refiriendose al "esfuerzo constante por parte de los poderes ejecutivo y judicial para impedir e incluso invalidar el funcionamiento normal de la Asamblea Nacional: " y al empleo repetido por parte del Ejecutivo de "intervenciones inconstitucionales en contra de la legislatura, con la connivencia de la Sala Constitucional del Tribunal Supremo de Justicia," lo que "demuestran claramente la falta de independencia del poder judicial," siendo ello "uno de los casos mas claros de cooptacion del Poder Judicial por el Poder Ejecutivo," con un Tribunal Supremo cuya integracion esta "completamente viciada tanto en el procedimiento de designacion como por la parcialidad politica de practicamente todos sus integrantes.""

This book examines the process of dismantling the democratic institutions and protections in Venezuela under the Hugo Chávez regime. The actions of the Chávez government have influenced similar processes and undemocratic manoeuvrings in Ecuador, Bolivia, and Honduras. Since the election of Hugo Chávez as president of Venezuela in 1998, a sinister form of nationalistic authoritarianism has arisen at the expense of long-established democratic standards. During the past decade, the 1999 Venezuelan Constitution has been systematically attacked by all branches of the Chávez government, particularly by the Supreme Tribunal of Justice, which has legitimized the Chávez-ordered constitutional violations. The Chávez regime has purposely defrauded the Constitution and severely restricted representative government, all in the name of a supposedly participatory democracy controlled by a popularly supported central government. This volume illustrates how an authoritarian, nondemocratic government has been established in Venezuela.
