The crusade against nuclear weapons in Great Britain, West Germany, France, and the Netherlands in the early 1980s dwarfed all previous protest movements in Western Europe in the postwar period. What produced the demonstrations against NATO's decision in December 1979 to base 572 cruise and Pershing II missiles in five West European countries? What generated the widespread support that the demonstrators enjoyed? Contrary to the frequent claim that such political movements are a symptom of governmental crisis in the advanced industrial democracies, Thomas Rochon develops the idea that they arise from a creative impulse and perform crucial functions of innovative criticism. He concludes that the West European peace movement has ignited a public debate in which reduction or elimination of certain categories of nuclear weapons is taken seriously for the first time. Among the topics examined are the sources of support for the peace movement in public opinion, the types of people who joined or supported the movement, and proposals they offered for a nonnuclear defense policy. The author discusses the organization of the movement and its choice of tactics, its impact on politics, and the links between it and other institutions such as churches, trade unions, and political parties. The imposition of strict liability in tort law is controversial, and its theoretical foundations are the object of vigorous debate. Why do or should we impose strict liability on employers for the torts committed by their employees, or on a person for the harm caused by their children, animals, activities, or things? In responding to this type of questions, legal actors rely on a wide variety of justifications. Justifying Strict Liability explores, in a comparative perspective, the most significant arguments that are put forward to justify the imposition of strict liability in four legal systems, two common law, England and the United States, and two civil law, France and Italy. These justifications include: risk, accident avoidance, the 'deep pockets' argument, loss-spreading, victim protection, reduction in administrative costs, and individual responsibility. By looking at how these arguments are used across the four legal systems, this book considers a variety of patterns which characterise the reasoning on strict liability. The book also assesses the justificatory weight of the arguments, showing that these can assume varying significance in the four jurisdictions and that such variations reflect different views as to the values and goals which inspire strict liability and tort law more generally. Overall, the book seeks to improve our understanding of strict liability, to shed light on the justifications for its imposition, and to enhance our understanding of the different tort cultures featuring in the four legal systems studied.

La désobéissance civile constitue un défi au Droit et aux règles de la démocratie représentative. La désobéissance civile s'enracine dans une histoire ancienne et complexe, que notre société, de plus en plus technicienne et individualiste, réactive. L'acte désobéissant connaît aujourd'hui un regain de vigueur, s'appuyant sur de nouveaux registres de légitimité. La contestation de la règle oblige les systèmes juridiques et politiques, notamment nos démocraties représentatives pluralistes, à reformuler les fondements de l'obéissance du citoyen à la loi. C'est que, contrairement aux contestations de type révolutionnaire, la désobéissance civile est une remise en cause de la règle juridique d'autant plus complexe qu'elle ne se situe pas en dehors du système légal mais en son sein, se revendiquant même comme une forme de participation démocratique à la production de la norme. Loin d'être un simple acte de négation de l'ordre politique, elle se revendique comme une contribution -?dont l'expression est certes particulière?- à l'extension du champ de la confrontation politique, en dehors des arènes représentatives. Ces interrogations relatives à la normativité ont déjà fait l'objet de recherches dans les diverses disciplines qui étudient le phénomène juridique. La science politique a, de son côté, étudié le mécanisme en suivant les formes de mobilisation que génère la figure du désobéissant. En revanche, il n'est pas habituel de les faire se rencontrer pour un travail inter-disciplinaire et encore moins autour de la désobéissance civile. Dans cette matière où débats théoriques et action pratique sont si intimement mêlés, il semble profitable de confronter ces deux points de vue. Ce livre propose donc un échange croisé et parfois contradictoire, sur les raisons et fins de la désobéissance civile.

Pour que le Nord vive dans l’opulence et le gaspillage, un milliard de personnes restent dans le sous-développement et cent mille d’entre elles meurent chaque jour de faim et de maladie. Un autre monde est possible et souhaitable ; pour l’atteindre, nous devons échapper à la manipulation mentale de masse exercée par les profiteurs qui nous poussent au productivisme et au consumérisme pour s’enrichir. Pour cela, nous devons éradiquer la violence qui est en nous en retrouvant les vraies valeurs du bonheur et du partage. Nous devons mener des combats non-violents de masse pour établir la justice sur terre. Cet essai présente les outils et un plan pour mener une Révolution non-violente planétaire.
