Seminar paper de l’année 2020 dans le domaine Droit - Droit communautaire/européen, Droit international, Droit privé international, note: 16, Ludwig-Maximilians-Universität München, langue: Français, résumé: Dans l’analyse qui va suivre les droits de la Charte vont englober à la fois le terme de droit, des droits fondamentaux et de liberté pour les opposer aux principes au sens de l’article 52 de la Charte des droits fondamentaux. Le droit de l’Union européenne parle souvent des principes dans des contextes assez différents qui peuvent tantôt se rapprocher du terme de droit ou des droits fondamentaux, tantôt s’en éloigner. La distinction entre les droits et les principes au sens de la Charte des droits fondamentaux existait déjà lors des Conseils européens de 1999 et se voit concretiser depuis le traité de Lisbonne notamment à l’article 52, paragraphe 5 de la Charte. Les principes semblent d’abord se distinguer des droits par leur nécessité de mise en œuvre pour pouvoir faire l’objet d’un contrôle ou d’une interprétation. Il s’agit d’une sorte de justiciabilité normative qui n’est pas exigée pour les droits qui ont un caractère plus subjectif que les principes. Ainsi l’article 51, paragraphe 1 de la Charte dispose que les droits doivent être respectés pendant que les principes doivent être observés.

"More than 30 years have elapsed since Robert Schuman's declaration of 9 May 1950 and the signature on 18 April 1951 of the Treaty of Paris establishing the European Coal and Steel Community. The time has come for the European Community to take stock. Both as a unique economic and human experiment, and as a reality endowed with powerful legal instruments, this singular phenomenon needs to be examined from the standpoint of history. The establishment of the Community was completed with the conclusion of the Treaties of Rome creating the European Economic Community and the European Atomic Energy Community. Its institutions have undergone several stages of development, including the merger of the executives, the creation of own resources, the extension of Parliament's budgetary powers and the creation of a Court of Auditors. At the same time the Community was putting into effect the fundamental principles of free movement of goods, persons, services and capital, and developing the common policies which are laid down in the Treaties or which proved necessary in order to attain, in the course of the operation of the common market, one of the objectives of the Community. On two occasions it has been enlarged by the accession of further European States, first Denmark, Ireland and the United Kingdom, and subsequently Greece. It has also commenced negotiations with a view to the admission of Spain and Portugal. The progress made by the Community is reflected in a vast range of legislation binding on Member States, firms and individuals, and in the body of case-law built up by the Court of Justice in Luxembourg. The Commission wished to provide a work of reference for lawyers which did not assume any familiarity with questions of Community law. It asked eminent specialists in the subject from the various Member States to make individual contributions to Thirty years of Community law so as to trace the development of the Community, summarize the progress achieved in the various sectors and examine the difficulties which the Community has had to face. Each author was allowed the fullest freedom of expression. Given the impact that successive court rulings have had on the organisation of the sports movement in the past 15 years, the autonomy of non-governmental sports organisations has become a highly topical concern in Europe. It is also closely related to the issue of governance, the subject of previous Council of Europe studies. The Enlarged Partial Agreement on Sport (EPAS) decided to explore the concept of autonomy in greater depth by studying the conceptual, political, legal, economic and psycho-sociological aspects of the subject. This study was carried out at the request of the EPAS by the Swiss Graduate School of Public Administration (IDHEAP) on the basis of a questionnaire sent to public authorities in charge of sport and to national and international umbrella sports organisations. In addition to an analysis of the data obtained, documents produced by public authorities and sports organisations on this emerging issue are presented. This study contributes to a better understanding of the concept of autonomy and offers a clear picture of the issues involved.

The aim of the Convention is to take account of social and legal developments while keeping to the European Convention on Human Rights and bearing in mind that the child's best interests must always take precedence over any other considerations. New provisions are introduced by the Convention. The father's consent is required in all cases, even when the child was born out of wedlock. The child's consent is necessary if the child has sufficient understanding to give it. The Convention extends to heterosexual unmarried couples who have entered into a registered partnership in States which recognise that institution. It also leaves States free to extend adoptions to homosexual couples and same sex-couples living together in a stable relationship. The new convention strikes a better balance between adopted children's right to know their identity and the right of the biological parents to remain anonymous. The minimum age of the adopter must be between 18 and 30, and the age difference between adopter and child should preferably be at least 16 years
