Equity is a multi-faceted subject, an authentic crossroads of problems. The perspective of this study is, as a result, a mix of focuses, which includes: the philosophy of law, general legal theory, justice theory, the history of law, comparative law, legal dogma, etc. In this book, as in various earlier studies of the author, she uses the "three-dimensional" method, which facilitates a stratified focus in agreement with three levels: facts, norms, and values. The subject of equity has never been analysed as completely as in this work. En la tradición jurídica la equidad se muestra como un concepto científico y dogmático, desprendido de la esencia del ser humano, o que incluso puede resultar repudiado como en el cientifismo formalista kelseniano. En esta obra se trata de otorgar un nuevo posicionamiento a la equidad como facultad incrustada en la esencia humana y en su capacidad para desvelar lo injusto y lo justo como sentido antropológico y ontológico de justicia. Por ello las recuperaciones más sociológicas e institucionales de la equidad que facultaron los pensamientos de clásicos del siglo XX como Perelman y Rawls, se antojan insuficientes. La equidad tiene que obtener un nuevo enclave jurídico y iusfilosófico desde la Hermenéutica, en el cual el juez debe disponer de una elevada dosis interpretativa con la cual resulte más fluido su compromiso como agente jurídico creador y responsable. Pero para ello sólo es posible comprender la equidad como una aspiración innegable y persistente en la existencia humana.Miguel Grande Yáñez nace en Castellón en 1969, si bien desde 1987 ha estado vinculado a Madrid y a su Universidad Pontificia Comillas, de la que es licenciado y diplomado, y profesor desde 1997. En 1999 obtiene el Doctorado por la Universidad de Valencia con una tesis doctoral sobre la Filosofía y el Derecho en Baltasar Gracián. Desde entonces no ha cesado de trabajar en el pensamiento del Barroco español, como es buena muestra De Cervantes a Calderón. En el conjunto del ordenamiento aparecen con frecuencia, al lado de las normas que expresan principios generales y de las más habituales reglas ordinarias de contenido específico preciso, normas que acogen conceptos elásticos o formulaciones abiertas, las cuales, si en un cierto momento fueron vistas, pese a la antigüedad y el prestigio de algunas de ellas, con no pocas reticencias, se consideran hoy constitutivas de una técnica insuprimible de la conformación del derecho escrito. Entre tales normas se encuentran las que contienen cláusulas generales en sentido estricto (como la buena fe, la moral o el orden público), conceptos jurídicos indeterminados (como, entre tantísimos otros, el interés del menor, la situación de desamparo, el cabal juicio, el extraordinario valor o la remuneración suficiente), modelos de apreciación referencial (como los de buen padre de familia, administrador leal o buen labrador) y parámetros de ponderación (como los de proporcionalidad, razonabilidad y, en una de las dos acepciones legislativas de la misma, equidad).Con los límites de una cierta contenida extensión, esta monografía se propone examinar, además de la configuración diferenciada de tales enunciados legales, su significación disciplinar y la aplicación de los mismos en la actividad judicial.
