La estructura de la obligación romana y el problema de su génesis es una obra constituida por un objeto consciente que refleja la esencia del maestro italiano Emilio Betti como historiador del derecho, o mejor, como “jurista historiador”. Al fijar las características que constituyen la estructura de la obligación romana clásica y, hasta donde resulta posible, de la obligación arcaica, el jurista historiador podrá luego compararla con la estructura de la obligación moderna y así observar las transformaciones, la heterogénesis de significados, la razón de ser histórica de un instituto jurídico de trascendental importancia en el Derecho. Emilio Betti se adentra en lo profundo del origen de la figura para indicar los momentos más relevantes de la concepción romana de la obligación, ¿e intentar dirimir la cuestión del origen vel ex contractu vel ex delicto? A partir de allí este autor revisa la originaria concepción de la reparación y del resarcimiento del daño. Nos lleva de la mano desde la historia de la sujeción a la acción penal-privada (vindicta), hacia la obligatio ex contractu revelando una heterogénesis de significados que involucran la necesidad expresada en el oportere, los significados de la palabra solutio y su relación con el contrahere. Aquello que es hoy distinto o que ya desapareció en el derecho moderno ilumina la “naturaleza originaria” de la obligación; proporciona una huella, una pista para rastrear su “génesis”, su origen. En 1917 Betti escribió la monografía La struttura dell'obbligazione romana e il problema della sua genesi publicada en el Annuario dell'università di Camerino (1918-1919). La Universidad Externado de Colombia tiene el gusto de presentar en esta ocasión la traducción al español de la segunda y última edición de la obra, publicada por la editorial italiana Antonio Giuffrè en el año 1955.
