Si tout droit postule la mise en place de lois strictes, ne tolérant aucune entorse ou dérogation, quelques exceptions à la règle existent toutefois et le droit de l'OMC est de celles-là. En effet, les Accords conclus au sein de l'OMC sont tout empreints de flexibilité. La présence d'une telle flexibilité dans les Accords de l'OMC est un élément essentiel du maintien de l'équilibre dans le système commercial multilatéral, qui, par nature, est déséquilibré, les forces en présence n'étant pas toutes au même niveau de développement. Plusieurs questions restent cependant posées: comment l'OMC parvient-elle à concrétiser sa volonté d'équilibre entre les Etats Membres? De quels mécanismes se dote-t-elle? Ceux-ci sont-ils véritablement performants et assurent-ils un juste équilibre entre les diverses revendications en présence? La flexibilité, présente dans la quasi-totalité des Accords, tente réellement de concilier les différentes revendications des Membres de l'organisation. Cependant, un constat doit être fait: la flexibilité a une portée limitée à deux égards. Tout d'abord, on ne peut que constater que les déséquilibres commerciaux entre les Etats Membres sont loin d'être résorbés. Enfin, la faiblesse majeure de la flexibilité est de ne pas pouvoir maintenir dans son intégralité le multilatéralisme du système commercial international. Ainsi, après avoir révélé les enjeux et les modalités de cette souplesse selon la nature des Etats concernés et après s'être interrogé sur les limites et les freins que cette même souplesse recèle, la question que l'on peut se poser est la suivante: quelle réforme impulser? Il existe, à l'heure actuelle, de réelles pistes pour éviter la fragmentation du système, notamment en renforçant le cadre multilatéral.

Information Law Series Volume 45 In a copyright system characterised by broad and long-lasting exclusive rights, exceptions provide a vital counterweight, especially in times of rampant technological change. The EU’s controversial InfoSoc Directive – now two decades old – lists exceptions in which an unauthorised user will not have infringed the rightholder’s copyright. To reform or not to reform this legal framework – that is the question considered in great depth in this book, providing detailed theoretical and normative analysis of the Directive, the national and CJEU case law arising from it, and meticulously thought-out proposals for change. By breaking down the concepts of ‘flexibility’ and ‘legal certainty’ into a set of policy objectives and assessment criteria, the author thoroughly examines such core aspects of the framework as the following: the justifications for exceptions, e.g., safeguarding the fundamental rights of users; the regimes established in legislation and case law for key exceptions; the need to promote technological development; the importance of avoiding re-fragmentation caused by uncoordinated national legislative responses to technological changes; the legal status of digital technologies that rely on unauthorised uses of copyright-protected works; and the pros and cons of importing a fair use standard modelled after that of the United States. L’intégration de l’Afrique dans une économie-monde multipolaire est ambivalente. S’inscrivant dans des mouvements centrifuges et centripètes, dans le temps et dans l’espace, l’insertion de ce continent dans les relations économiques et financières internationales se caractérise par une diversité des situations nationales. Dans le cadre d’une mondialisation multidimensionnelle, l’Afrique a longtemps été considérée comme marginalisée et contrainte de s’y adapter. Elle apparaît, désormais, comme un de ses acteurs. L’ouvrage interroge le sens et la portée de cette intégration. Quelles formes prend-elle ? Dans quelles dynamiques s’inscrit-elle ? L’Organisation mondiale du commerce a-t-elle un lien avec la fiscalité directe ? Cette question peut sembler surprenante. En effet, l’inspiration première de lutte contre le protectionnisme a naturellement doté l’O.M.C. d’une compétence en matière de fiscalité indirecte. Pourtant, le nombre de décisions rendues par l’Organe de règlement des différends, en matière de fiscalité directe, ne cesse de croître. Toutes ces affaires sont relatives soit au principe de non-discrimination soit au principe d’interdiction des subventions fiscales. Le constat est exactement le même en droit de l’Union européenne. Dans ce contexte, l'ouvrage analyse et compare la consistance de ces deux principes dans le cadre de deux espaces normatifs aux finalités différentes. La comparaison du droit de l’O.M.C. et du droit de l’U.E. sous l’angle de la fiscalité directe met en évidence l’imbrication de ces deux sources de droit. Cet enchevêtrement conduit tantôt à un rapprochement des règles édictées dans ces deux cadres, tantôt à un traitement différencié. Il n’est donc pas étonnant de constater l’influence du droit de l’O.M.C. sur le droit de l’U.E. ou inversement, mais également la volonté de l’un ou de l’autre de ces systèmes de ne pas subir une telle influence. Par conséquent, chaque système ne se suffit pas à lui-même en même temps qu’il élabore ses règles et rend ses décisions dans le champ de référence qui est le sien. Ainsi, le droit de l’O.M.C. prospère dans le cadre du libéralisme économique où la logique sociale est absente, tandis que l’U.E. prospère dans celui d’une logique d’intégration économique à la lumière des droits fondamentaux. Dans ce contexte, le principe de non-discrimination et le principe d’interdiction des subventions fiscales développés dans ces deux espaces coïncident-ils ? Existe-t-il un lien entre les deux ? Pour répondre à ces questions, nous avons dû confronter ces deux règles et tirer les conséquences de cette dualité de sources sur le droit fiscal français. L’ouvrage intéressera tant les praticiens que les universitaires spécialisés en fiscalité, mais aussi en droit international et communautaire.
