La fuite en Suisse Les Juifs à la frontière franco-suisse durant les années de « la Solution finale » Itinéraires, stratégies, accueil et refoulement À l’été 1942, « la Solution finale de la question juive » est déclenchée aux Pays-Bas, en Belgique et en France. Des milliers de Juifs prennent la fuite en direction de la Suisse, à travers la zone occupée ou la zone libre. Beaucoup sont arrêtés pendant leur voyage et déportés. Certains atteignent néanmoins la frontière helvétique. La Suisse, attachée à sa politique d’immigration ultra-restrictive à tonalité antisémite, se voit acculée à l’adoption de mesures d’urgence : elle entrouvre ses portes à certaines catégories de fugitifs. Mais son attitude, chaotique et peu lisible, reflète des tensions internes. Plus de 12 500 Juifs venus de ou à travers la France sont accueillis. Près de 3 000 sont refoulés et abandonnés à leur sort – tous, cependant, ne périront pas en déportation. Cet ouvrage est le premier à s’appuyer sur les archives conservées de part et d’autre de la frontière : dossiers helvétiques des réfugiés, dossiers préfectoraux français, archives des organisations d’entraide et sources mémorielles. Il retrace ce périlleux voyage vers la Suisse, qui perdure jusqu’à la Libération, malgré les régimes changeants des territoires traversés et, au bout, l’inconnu de l’accueil ou du refoulement. Il dessine aussi les profils des acteurs qui se croisent alors : les Juifs qui se décident pour la fuite ; les exécutants et collaborateurs de la politique d’extermination ; les responsables suisses à la ligne politique (hélas !) fluctuante. Il fait revivre enfin les réseaux, payants ou bénévoles, de passeurs, que viennent peu à peu renforcer les solides réseaux de la résistance juive, pour qui la Suisse devient un outil de la panoplie de sauvetage.

The present volume highlights the new challenges of the international protection of refugees fifty years after the adoption of the 1951 Geneva Convention relating to the Status of Refugees. Focusing on the problems faced by Switzerland in the field of international protection of refugees as well as on the specificity of its asylum law and practice, this publication addresses the refugee problem from a national, European and international perspective. The Swiss experience serves to illustrate the wider problematic of on the one hand, the tensions between security, political and humanitarian concerns encountered by refugee-receiving states, and on the other, the need to preserve an international refugee protection regime which remains an essential component of international law and relations for so long as political solutions are not brought to the root causes of refugee exodus. This reflection on the international protection of refugees is organized around four main themes. The first examines Switzerland's response in the past to mass influx, in the light of historical case studies and the evolution of Swiss asylum law and practice. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. The third centres on the wider protection regime currently being forged in Europe to address a broader category of refugees, including solutions for temporary and subsidiary protection. The final theme revolves around return of refugees, including those under the Dayton and recent Kosovo agreements and covers reintegration of returnees, assistance and long-term development. This work is based on papers presented at a colloquium of the Graduate Institute of the International Studies in Geneva which was organised in collaboration with the Office of the United Nations High Commissioner for Refugees as a contribution to the 50th anniversaries of the UNHCR and the Geneva Convention relating to the Status of Refugees.

Defends Switzerland's conduct during World War II against criticism which arose in American Jewish circles between 1996-98 of that country's financial dealings with the Third Reich and its restrictive immigration policies during the war. This book conceptualizes the EU’s ambition at exercising a “joined up approach” (i.e. the mobilization of EU sectoral policies to realize EU foreign policy goals towards a third country). The framework is applied to three case studies: Switzerland and the Institutional Framework Agreement, Morocco and the Western Sahara issue, and Israel and the Israeli-Palestinian conflict. With the help of these, the author argues that the EU is more likely to follow foreign policy objectives by leveraging on sectoral cooperation ties when the foreign policy objective concerns the conditions of participation in the single market (Switzerland). He also shows that a lack of member states’ coherence concerning the compatibility of the foreign policy objective with overarching economic (Israel) or regional/geopolitical (Israel and Morocco) interests counteracts the exercise of a joined-up approach.
