Esta tendencia ha resultado especialmente provechosa en el ámbito de la normativización de la tipicidad gracias a la teoría de la imputación objetiva, con independencia de que quizás no sea “objetiva” la expresión más afortunada. Esta normativización de la tipicidad ya no se limita exclusivamente a la imputación de resultados a conductas, sino que se extiende a todos los ámbitos de la tipicidad. Lejos quedan los tiempos en los que era objeto de reflexión doctrinal generalizada si la denominada teoría de la imputación objetiva también era válida para los delitos de peligro o para los delitos de mera actividad. Si se parte de la idea de que se trata de imputar injustos penales a personas concretas, los criterios normativos relevantes abarcan cualquier modalidad de injusto penal. Confío en que este análisis de problemas generales de la teoría jurídica del delito con base en los delitos económicos como paradigma de lo que se ha denominado “moderno Derecho Penal” sirva para abrir nuevas perspectivas tanto de las instituciones de la parte general del Derecho Penal como de un grupo de figuras delictivas que cada vez es más evidente que no se dejan abarcar con planteamientos que provienen de la teorización de otros tipos delictivos más clásicos (por ejemplo, la estafa)". Se trataría de repensar la teoría de la imputación objetiva teniendo en cuenta las cuestiones dogmáticas relacionadas con las organizaciones empresariales y repensar los aspectos de la criminalidad de empresa a partir de la tendencia a una progresiva normativización de las categorías de la tipicidad. En este libro se pueden encontrar herramientas conceptuales que permiten abordar uno de los retos más apasionantes en la actualidad para la teoría jurídica del delito".
