L'import-export institutionnel, une formule bien connue des spécialistes du mimétisme juridique, est sans aucun doute l'expression la plus appropriée pour qualifier la réception du modèle français de justice administrative en Afrique noire. La germination et l'évolution de cette institution coïncideront avec le développement de l'administration coloniale. Elle sera maintenue au moment de l'accession à la souveraineté internationale, même si son organisation variera selon les Etats : d'un côté, ceux qui, suivant l'exemple du Sénégal, ont, par souci de simplification, rompu avec la conception française de la dualité juridictionnelle ; et de l'autre, ceux dont le chef de file pourrait être la République malgache et qui ont préféré une solution plus proche du système précédent. C'est dans cette dernière catégorie qu'il faut ranger le Gabon et le Cameroun, deux Etats voisins d'Afrique centrale. Cependant, le poids budgétaire de la nouvelle organisation et surtout l'absence de personnel spécialisé en contentieux administratif ont conduit dans la plupart des Etats à mettre en place une Cour suprême polyvalente. L'ouverture de la transition démocratique amorce également le démantèlement de ce monisme juridictionnel, en cela que la tendance est plutôt à la mise en place de juridictions administratives autonomes. Tous ces atermoiements témoignent de la difficulté des Etats africains à se doter d'un système adapté pour le règlement des litiges opposant l'administration à ses administrés. Dans un continent où l'on aspire plus que jamais à l'instauration et la consolidation de l'Etat de droit, ce n'est plus l'opportunité d'une telle institution qui serait matière à interrogations. En revanche, son organisation, son intégration dans un milieu sociologique parfois hostile continuent d'alimenter les débats aussi bien doctrinaux que politiques. Ceux qui incarnent l'institution ne sont pas en reste. Ainsi, la timidité du juge administratif et sa promptitude à importer la jurisprudence étrangère, particulièrement française, sont loin de favoriser l'émergence d'un droit public qui soit adapté aux Etats.
