This book focuses on one part of the judicial system: the criminal justice chain. This involves all the activities and actors dealing with policing, prosecution, judgment, and sanctioning of crimes. In the last decades, reforms have been implemented in several European countries. In Belgium, for example, there was the so-called Octopus reform in 1998. The police was restructured, leading to an integration of the police forces on a national and local level. New steering instruments were introduced, such as regional security plans. With regard to the sanctioning of crimes, a new institution was installed, called the sentence implementation court. This book evaluates these reforms and discusses the current reform on the reorganization of the judicial landscape. In addition, it examines the relation between trust and distrust and the application to the judicial system. It discusses the human capital aspect of the system, by means of a study on the prosopography of the Belgian magistrates that analyses the Magistracy as socio-professional group, and focuses on situations of system building, transformations under constraint (occupations), and transfers (colonial experience). Lastly, the book presents a comparative study of Belgium and France regarding the new techniques and instruments that are needed to accelerate the judicial response time and to ensure that the judicial system delivers its services on time.

L'objectif de ce livre est d’observer le fonctionnement de la justice dans l’arrondissement judiciaire de Mons durant les deux guerres mondiales, face aux douloureuses réalités des collaborations et des résistances avec l’occupant allemand. Les conséquences de ces deux occupations se font sentir dès le mois d’août 1914 et jusqu’aux dernières suites pénales de l’épuration de la Seconde Guerre mondiale (1961). Au fil de six contributions – deux sur la première guerre, quatre sur la seconde –, occupations et libérations sont abordées comme des réalités vécues au quotidien par des gens ordinaires. Les tensions de la première occupation sont éclairées par les confrontations entre polices allemandes et espions ou résistants et les poursuites des « inciviques » par des juges en uniforme après l’armistice. À la fin de la seconde occupation, les homicides de vengeance, la prise en charge des collaborateurs juvéniles, l’épuration des sympathisants de l’Ordre Nouveau et le procès de la « bande Chéron », un groupe de rexistes passés à la violence sanglante, dessinent une société clivée sur le plan économique, social, politique et culturel et soumise à une occupation plus dramatique que la première. Dans une atmosphère de quasi « guerre civile », la justice, qu’elle soit civile ou militaire, est investie d’une mission de rétablissement de l’ordre social et de pacification des comportements.

L'histoire des justices militaires a jusqu’il y a peu été largement négligée. Institution hybride, elle a longtemps fait l’objet de jugements à l’emporte-pièce, tant chez les militaires que chez les juristes. On a ainsi vu se multiplier critiques acerbes et plaidoyers pro domo autour de cette institution si particulière. Une série de séminaires menés dans le cadre du projet de la Maison des sciences de l’Homme, de 2004 à 2008, avait pour objectif de parcourir, en perspective comparée, les évolutions de la justice militaire depuis le XVI e siècle. Le présent volume reprend reprend une vingtaine de ces contributions, orientées sur le premier XXe siècle, pour comprendre les tensions, les pratiques et les limites de la justice militaire pendant et autour des deux guerres mondiales. Parcourant l’Europe occidentale, il se veut méthodologique et initiateur, éclairant une réalité transnationale à l’aide d’études de cas, inscrites dans le temps et l’espace. Until recently, the history of military justice has been largely neglected. As a hybrid concept, it has for many years been the subject of hasty judgments from both military institutions and lawyers. Members of the military institutions kept repeating harsh criticisms while the lawyers kept justifying themselves. This volume brings together 20 contributions that focus on the early 20th century in Western Europe with the aim of examining the tensions, practices and limitations of military justice during the two World Wars. In doing so, it uses a methodological and original approach, from the perspective of transnational reality and uses case studies from a range of countries at different times. The contributions were all presented during multiple seminars held at the Maison des sciences de l’Homme between 2004 and 2008. Using a comparative perspective, these seminars explored the evolution of the military justice system since the 16th century.

This book outlines with theoretical and literary historical rigor a highly innovative approach to the writing of Russian literary history and to the reading of canonical Russian texts. "Anticipatory plagiarism” is a concept developed by the French Oulipo group, but it has never to my knowledge been explored with reference to Russian studies. The editors and contributors to the proposed volume – a blend of senior and beginning scholars, Russians and non-Russians – offer a set of essays on Gogol, Dostoevsky, and Tolstoy which provocatively test the utility of AP as a critical tool, relating these canonical authors to more recent instances, some of them decidedly non-canonical. The senior scholars who are the editors and most of the contributors are truly distinguished. The volume is likely to receive serious attention and to be widely read. I recommend it with unqualified enthusiasm. The presentation of Europe's immediate historical past has quite dramatically changed. Conventional depictions of occupation and collaboration in World War II, of wartime resistance and post-war renewal, provided the familiar backdrop against which the chronicle of post-war Europe has mostly been told. Within these often ritualistic presentations, it was possible to conceal the fact that not only were the majority of people in Hitler's Europe not resistance fighters but millions actively co-operated with and many millions more rather easily accommodated to Nazi rule. Moreover, after the war, those who judged former collaborators were sometimes themselves former collaborators. Many people became innocent victims of retribution, while others--among them notorious war criminals--escaped punishment. Nonetheless, the process of retribution was not useless but rather a historically unique effort to purify the continent of the many sins Europeans had committed. This book sheds light on the collective amnesia that overtook European governments and peoples regarding their own responsibility for war crimes and crimes against humanity--an amnesia that has only recently begun to dissipate as a result of often painful searching across the continent. In inspiring essays, a group of internationally renowned scholars unravels the moral and political choices facing European governments in the war's aftermath: how to punish the guilty, how to decide who was guilty of what, how to convert often unspeakable and conflicted war experiences and memories into serviceable, even uplifting accounts of national history. In short, these scholars explore how the drama of the immediate past was (and was not) successfully "overcome." Through their comparative and transnational emphasis, they also illuminate the division between eastern and western Europe, locating its origins both in the war and in post-war domestic and international affairs. Here, as in their discussion of collaborators' trials, the authors lay bare the roots of the many unresolved and painful memories clouding present-day Europe.
