En Perú, y en varios países de Latinoamérica, los cambios que han supuesto la reforma procesal han sido acogidos con entusiasmo, y en algunos casos, como en el peruano, sin el tamiz crítico necesario. Es cierto, que los mecanismos de simplificación procesal pueden servir de medio para lograr la eficacia del proceso; pero también lo es, que su aplicación afecta al modelo procesal hasta ahora asumido: al juicio oral, y público, con todas las garantías que le son inherentes; y la obligatoriedad de la aplicación del Derecho penal, al introducir auténticas vías de "descriminalización procesal". Como se verá a lo largo del presente trabajo, la importación de principios propios del proceso civil al penal atañe a la propia configuración del proceso; esto es, al proceso penal tal como hoy en día es concebido en los sistemas continentales, a tal punto que pone de manifiesto la contradicción que supone defender "a capa y espada" un proceso con todas las garantías (incluida la del juicio oral, público y contradictorio) al tiempo que fomenta otros medios de poner fin al proceso. Unas veces se trata de procedimientos simplificados que restringen en mayor o menor medida determinadas garantías procesales, y otras de auténticas alternativas al procedimiento.
