In un momento storico nel quale la liberta' religiosa e' gravemente minacciata da quello che appare un conflitto globale dei valori, e nel quale guerre, atti di terrorismo e persecuzioni, che sono la negazione stessa della dignita' umana, vengono compiuti in nome della religione, il convegno si prefiggeva di compiere un passo in avanti nella definizione "approfondita e grandemente precisa", per stare all'auspicio espresso da Papa Francesco, dei presupposti giuridici e politici della liberta' religiosa, necessari per assicurarne l'effettivo ed universale riconoscimento quale diritto fondamentale della persona umana, base essenziale di una convivenza giusta e pacifica, a livello nazionale e internazionale, che persegua il bene comune dell'umanita'.

The UN International Covenant on Civil and Political Rights obliges state parties to prohibit any advocacy of religious hatred that constitutes incitement to discrimination or violence. This book traces the origins of this provision and proposes an actus reus for this offence. The question of whether hateful incitement is a prohibition per se or also encapsulates a fundamental 'right to be protected against incitement' is extensively debated. Also addressed is the question of how to judge incitement. Is mens rea required to convict someone of advocating hatred, and if so, for what degree of intent? This analysis also includes the paramount question if and to what extent content and/or context factors ought to be decisive. The author extensively engages with comparative domestic law and compares the workings of the UN Human Rights Committee with those of the UN Committee on the Elimination of Racial Discrimination and the European Court of Human Rights.

This highly topical new study clearly shows how there are at least two reasons to question the central role that is assigned to religion, in particular Islam, when explaining suicide terrorism. suicide terrorism is a modern phenomenon, yet Islam is a very old religion. Except for two periods in the twelfth and eighteenth centuries, suicide was never part of Islamist beliefs and behaviours. Actually, Islam clearly forbids suicide, hence, the argument that Islamic religious beliefs are the main cause of suicide terrorism is inherently dubious many suicide attacks have been carried out by secular organizations with little connection to fundamentalist Islam: Palestinian Fatah; the Popular Front for the Liberation of Palestine; and the Kurdish Workers Party. Moreover, one of the organizations that has employed this strategy devastatingly and regularly is the LTTE (Liberation Tigers of Tamil Elam). Not only are members of this organization not Muslim, most of them are not religious at all.
