This volume explores the relation between legal reasoning and logic from both a historical and a systematic perspective. The topics addressed include, among others, conditional legal acts, disjunctions in legal acts, presumptions and conjectures, conflicts of values, Jørgensen ́s Dilemma, the Rhetor ́s Dilemma, the theory of legal fictions and the categorization of contracts. The unifying problematic of these contributions concerns the conditional structures and, more particularly, the relationship between legal theory and legal reasoning in the context of conditions. The contributions in this work constitute the first results of the ANR-DFG joint research project “JuriLog” (Jurisprudence and Logic), which aims at fostering the cooperation between legal scholars and philosophers. On the one hand, lawyers and legal scholars have an interest in emphasizing the logical character of legal reasoning. In this respect, the present enquiry examines the question of how logic, especially newer forms of dialogical logic, can be made fruitful as a significant area of philosophy for jurisprudence and legal practice. On the other hand, logicians find in legal reasoning a striving towards clear definitions and inference-procedures that is relevant to their discipline. In order to fully understand such reciprocal relationships, it is necessary to bridge the gap between law, logic and philosophy in contemporary academic research. The essays collected in this volume all work towards this common goal. The book is divided in three sections. In the first part, the strong relation between Roman Law and logic is explored with respect to the analysis of disjunctive statements in legal acts. The second part focuses on Leibniz ́s legal theory. The third part, finally, is dedicated to current interactions between law and logic.

The reactivation of the Security Council at the beginning of the last decade has resulted, since the invasion of Kuwait by Iraq on August 2, l990, in increasing use of its powers under Chapter VII of the Charter and the adoption of measures against a number of state and non-state entities. The notion of a threat to the peace has now come to encompass violations of fundamental norms of international law such as human rights and humanitarian law, and the wide-ranging measures adopted have included such innovations as the establishment of the UN Compensation Commission or that of the two international criminal tribunals for Former Yugoslavia and Rwanda. These measures have not only infringed on the legal rights of the targeted state (sometimes with irreversible effects where they have remained in force over a long period of time) and its population, but also on those of implementing states and of private rights within these states. The current debate over the legitimacy and long-term effects of economic sanctions on states and their populations makes it imperative to re-evaluate this instrument and the broader peace maintenance function of the Security Council in the light of current community concerns. Part One of this book addresses the theoretical issues by focussing on: 1) The place of sanctions in the international legal system; 2) the limits to the powers of the Security Council and the question of accountability; and 3) an assessment of the alternatives to collective economic sanctions. Part Two looks at the relationship between sanctions and humanitarian issues, examining the relationship between: 1) Sanctions and human rights law; 2) sanctions, humanitarian issues and mandates; and 3) sanctions and humanitarian law. Part Three focuses on implementation by states of Security Council sanctions resolutions by examining: 1) Sanctions and private rights; and 2) special problems for implementing states. Part Four addresses the future in reassessing the place and ethics of sanctions in an international legal system which is giving increased importance to the individual. This work is based on papers presented at a colloquium of the Graduate Institute of International Studies in Geneva.

" L'observateur de la classe politico-administrative française ne peut s'empêcher de constater combien l'exercice du pouvoir y est conforme au modèle des sociétés plurales. Il ne s'agit pas ici du pouvoir théorique organisé par la Constitution et décrit dans les manuels, celui du Parlement et du Gouvernement, mais plutôt de celui des grands corps et des états-majors de partis et de syndicats : ce sont les détenteurs du pouvoir réel. Chacun le détient dans un domaine bien déterminé. Les ministres passent, mais les Grands Corps conservent chacun autant de représentants dans les cabinets et à la tête des administrations centrales. Perdre une direction déclenche la bataille de tout un corps contre le gagnant et entraîne une obligation de compensation. Dans ce partage, chacun a besoin des autres. Nulle décision ne peut se passer d'un accord des diverses directions intéressées, des responsables des finances de l'Etat et des corps de contrôle. Ces accords sont souvent des accords de compensation tacite : le conseil d'Etat s'égale au législateur en énonçant des principes généraux du Droit et s'impose à l'administration en soutenant qu'il lui revient de contrôler le rapport entre le coût et les avantages de son action ; mais en échange il consent à ne contrôler ni les actes de gouvernement ni dans une certaine mesure son pouvoir discrétionnaire. En bref chacun sacrifie aux autres : c'est la logique d'une société plurale. Et l'appareil décisionnel de l'Etat qui ressemble à un synthétiseur des opinions des divers groupes qui le dirigent, rappelle fortement la nécessité d'unanimité dans les sociétés africaines. C'est que ces groupes qui luttent pour le pouvoir savent qu'ils ne peuvent s'en remettre à une autorité supérieure pour régler leurs conflits : leur position à la tête de l'Etat les oblige à les résoudre eux-mêmes " (Extrait de l'ouvrage).
