This book brings together the proceedings of the meeting held in Florence on 21 October 2010, during which a group of Italian and foreign scholars reflected on the decisions set forth in the EC Directive 2008/52 regarding various aspects of mediation in civil and commercial matters, on the commitment that awaits the Member States called upon to implement it and on the contribution that its reception can offer to the renewal of civil justice in Europe. Even apropos the manner in which civil disputes are resolved, European integration is moving towards bringing the various national systems closer. It would, however, be mistaken to think that the differences which in the past so strongly marked the various legal systems are destined to disappear. Instead these divergences will live on in the different dimension of a shared European adventure.

L’opera pubblica gli atti di un Convegno avente come oggetto la Mediazione ed analizza l’istituto della mediazione finalizzata alla conciliazione delle controversie civili e commerciali, disciplina emanata dapprima con il D.Lgs. 17 gennaio 2003, n. 5 e successivi regolamenti attuativi e, da ultimo, con il D.Lgs. 4 marzo 2010, n. 28. Tale decreto è stato emanato in attuazione dell’art. 60 della legge 18 giugno 2009, n. 69, recante delega al Governo in materia di mediazione e di conciliazione delle controversie civili e commerciali, a chiusura e tempestivo adempimento delle istanze rivolte agli Stati membri della Comunità europea, da ultimo, con la Direttiva del Parlamento europeo e del Consiglio in data 21 maggio 2008, n. 2008/52/CE. La mediazione è quindi divenuta un istituto giuridico tipico e codificato dell’ordinamento italiano e questo volume ne illustra la ratio, le finalità e precisa le competenze dei notai e degli avvocati in tale ambito. STRUTTURA Il volume pubblica gli interventi degli illustri relatori, una completa appendice legislativa ed un’accurata selezione delle prime applicazioni giurisprudenziali in materia.
