Affermare ciò vuol dire anche porre le basi del conflitto, infatti, dal momento in cui cerco di imporre o proporre il mio punto di vista confliggo con il punto di vista del mio interlocutore. Nel momento in cui sono parte in causa divento un “negoziatore di realtà”. Molto è stato scritto sulle tecniche di negoziazione, e si suol dire che anche in una negoziazione riuscita devo cedere parte di ciò che vorrei per me. La mediazione famigliare cerca di superare questo stallo della negoziazione (che non è, di per sé un errore, a volte, la negoziazione è inevitabilmente sana e produttiva) cercando una terza via, ossia un superamento dei punti vista creando un percorso che ci faccia interpretare una realtà nuova ricostruendo i parametri del nostro vivere rispetto a un quadro generale diverso e condiviso. Ciò comporta impostare uno stile comunicativo e d’interpretazione della realtà, completamente nuovo e impegnativo. Si tratta da parte del mediatore di sospendere il giudizio: “L’individuo si sforza di applicare un’operazione di espansione semantica che rende nozioni, concetti categorie, strumenti concettuali e linguistici inclusi, anche se differenti nelle proprie nozioni, configura un’operazione di espansione del senso delle proprie convinzioni, sospende il giudizio”. Questo libro si pone l’obiettivo di essere una guida per i mediatori formati, che vogliono riflettere sulla loro professione, e a chi, a questa professione comincia ad affacciarsi.

In this important study, economist and lawyer Allen Parkman shows how no-fault divorce has systematically operated against the interests of these women and children. With rare economic and legal insight, Parkman argues that by changing the grounds for divorce without changing the laws that define and allocate property at divorce, the legal system created substantial injustices. The key mistake, he suggests, was in accepting a definition of property that did not include the income-earning capacity--human capital--of the individuals involved. Using human capital theory, Parkman criticizes current divorce law and presents a framework for reform that would reduce the injustices introduced by no-fault divorce. He concludes that a thorough reform, however, may require the changing of the grounds for divorce to mutual consent.
