À coté de l'objectif immédiat d'uniformiser les législations des États membres, l'OHADA s'est fixée un objectif médiat, celui de créer un vaste marché sans frontière. Or au regard des difficultés pour les sociétés commerciales de déplacer leurs sièges sociaux d'un État membre à un autre, nous ne pouvons que constater que l'existence de ce marché intégré n'est pas encore une réalité pour elles. Il apparaît alors que la seule uniformisation du droit des sociétés commerciales par l'OHADA ne suffit pas à leur permettre de réaliser des opérations de restructuration transfrontalière. Cette thèse a ainsi montré que l'OHADA a besoin d'évoluer et de se transformer pour mettre en place un véritable droit à la mobilité pour les sociétés commerciales au sein son espace communautaire. Elle doit pour cela compléter son intégration juridique par une intégration économique consacrant un libre établissement dont les opérations de mobilité seraient des modalités d'exercice, comme l'a fait l'Union européenne. Ce droit à la mobilité ne devra toutefois pas s'exercer de manière abusive. L'OHADA devra donc trouver un équilibre entre une mobilité fluidifiée et une protection efficace des actionnaires, salariés et tiers. De même il conviendra de rechercher un équilibre dans la gestion de la coexistence des normes communautaires qui ne manquera pas de se présenter dans le régime des opérations de mobilité puisqu'il s'agit d'un problème récurrent dans l'espace OHADA.

Le contexte mondial est porteur d’un possible renouveau pour la francophonie… ou de son effacement progressif. Les bouleversements en cours réinterrogent les identités. Les enjeux géoculturels deviennent structurants, des langues s’affirment, consolident leurs espaces naturels et se diffusent au-delà. Le chinois, l’arabe, l’espagnol, le portugais notamment sont de celles-là. À l’heure où la diplomatie d’influence joue un rôle prépondérant, des pays ont pris conscience du vecteur linguistique dans l’affirmation de leur puissance, tandis que d’autres ont compris leur intérêt à s’unir autour de la langue. La langue française peut être une composante majeure du plurilinguisme mondial. C’est un enjeu qui relève directement de notre intérêt national et il en va certainement de même pour les autres nations qui ont le français en patrimoine vivant. Pour chacune d’elles, la langue française et son poids sont un atout inestimable pour se renforcer dans l’économie et le commerce mondial. Langue officielle, nationale ou populaire dans une trentaine de pays dans le monde, de tous niveaux de développement, dans une diversité inouïe d’usages et d’histoires, le français est aussi une langue désirée. Encore faut-il en avoir conscience et, si on veut promettre à la langue française un avenir, encore faut-il que les francophones du monde entier s’accordent – aient envie de s’accorder – sur une stratégie internationale. Cette nouvelle ambition francophone peut être portée par un premier cercle, un noyau dur. L’objectif du présent rapport est de mobiliser les représentations nationales et les citoyens, d’éclairer les gouvernements et d’apporter une contribution utile au prochain sommet de la Francophonie autour des immenses potentialités de développement économique, d’innovations techniques, de découvertes scientifiques et de rayonnement culturel pour tous ceux qui choisiraient de s’unir autour de la langue française. Car la francophonie de projets s’incarne aussi bien en culture, en sciences, en politique qu’en économie. Les propositions, issues des travaux de la mission d’information créée par la commission des Affaires étrangères, se veulent pragmatiques et concrètes. Elles s’inspirent des belles idées et des courageux projets conduits par nos amis du Québec, d’Afrique et d’Europe. Il s’agit de rendre cette utopie francophone résolument possible, en explorant toutes les pistes d’actions envisageables. Cette ambition ne sera crédible que si en France même, loin de la désinvolture de ses élites ces dernières années, on l’honore chaque jour ici et en dehors et si, enfin, nous scellons avec les autres langues du monde une alliance pour le plurilinguisme, y compris dans les instances internationales.

The forced migration of Africans to the Americas through the trnasatlantic slave trade created primary centres of settlement in the Caribbean, Brazil and the United States - the cornerstones of the New World and the black Americas. However, unlike Brazil and the US, the Caribbean did not (and still does not) have the uniformity of a national framework. Instead, the region presents differing situations and social experiences born of the varying colonial systems from which they were developed. Using the Caribbean experience as the focus, Christine Chivallon examins the transatlantic slave trade and slavery as founding events in the identification of a black diaspora experience. The exploration is extended to include the United States to exemplify contrasting situations in slavery-based systems and identifies the links between the expressions of culture emanting from the black populations of the New World and the diversity of interpretations of the cultural identities of the black Americas.Divided into three main parts, The Black Diaspora of the Americas firstly examines the foundation of the black experiences of the New World by considering the slave trade. The second part takes a more theoretical examination of 'black diaspora' using Rastafarianism, Garveyism and Pan-Africanism while referencing the work of a range of thinkers including Stuart Hall, Paul Gilroy, Richard Price, douard Glissant, Melville Herskovits and Sidney Mintz. Managing the ability of agriculture to meet rising global demand and to respond to the changes and opportunities will require good policy, sustained investments, and innovation - not business as usual. Investments in public Research and Development, extension, education, and their links with one another have elicited high returns and pro-poor growth, but these investments alone will not elicit innovation at the pace or on the scale required by the intensifying and proliferating challenges confronting agriculture. Experience indicates that aside from a strong capacity in Research and Development, the ability to innovate is often related to collective action, coordination, the exchange of knowledge among diverse actors, the incentives and resources available to form partnerships and develop businesses, and conditions that make it possible for farmers or entrepreneurs to use the innovations. While consensus is developing about what is meant by 'innovation' and 'innovation system', no detailed blueprint exists for making agricultural innovation happen at a given time, in a given place, for a given result. The AIS approach that looks at these multiple conditions and relationships that promote innovation in agriculture, has however moved from a concept to a sub-discipline with principles of analysis and action. AIS investments must be specific to the context, responding to the stage of development in a particular country and agricultural sector, especially the AIS. This sourcebook contributes to identifying, designing, and implementing the investments, approaches, and complementary interventions that appear most likely to strengthen AIS and to promote agricultural innovation and equitable growth. It emphasizes the lessons learned, benefits and impacts, implementation issues, and prospects for replicating or expanding successful practices. The information in this sourcebook derives from approaches that have been tested at different scales in different contexts. It reflects the experiences and evolving understanding of numerous individuals and organizations concerned with agricultural innovation, including the World Bank.
