Con la condena por parte de la Corte Interamericana de Derechos Humanos (CoIDH) al Estado mexicano, en la sentencia del caso Radilla Pacheco, y la reforma constitucional en materia de derechos humanos, se abrió un nuevo panorama en el sistema jurídico mexicano, para que mediante el cumplimiento de dicha sentencia, se aplicaran no sólo los tratados internacionales, sino también las sentencias pronunciadas por la CoIDH. Lo cual, trajo aparejada una serie de interrogantes que no quedaron del todo aclaradas con las decisiones de la Suprema Corte de Justicia de la Nación en el expediente varios 912/2010 y en la contradicción de tesis 293/2011, en lo relativo a la vinculación de la jurisprudencia sustentada por la CoIDH para el Poder Judicial del país, qué elementos integran la jurisprudencia del sistema interamericano de derechos humanos, así como cual sería la naturaleza de ese case law y si se cumplió o no.

The desirability, or lack thereof, of bills of rights has been the focus of some of the most enduring political debates over the last two centuries. Unlike civil and political rights, social rights to the meeting of needs, standardly rights to adequate minimum income, education, housing, and health care are not usually given constitutional protection. This book argues that social rights should be constitutionalized and protected by the courts, and examines when such constitutionalization conflicts with democracy.
