Apparue avec les procès de l'après-guerre, la notion d'infraction internationale par nature s'est consolidée au fil du développement du droit international pénal. Si elle est aujourd'hui pleinement acquise, cette notion n'en demeure pas moins mal circonscrite. On s'accorde généralement à reconnaître que les crimes qu'elle embrasse sont les plus graves qui soient, mais ce critère est bien trop fuyant pour fonder une définition notionnelle. Cette étude a pour objet de préciser le contenu et les contours de cette catégorie juridique particulière, par l'identification des critères stables des différents crimes relevant de cette catégorie, à savoir le crime d'agression, le crime de guerre, le crime contre l'humanité et le crime de génocide. La structure juridique de ces infractions fournit un point de départ propice à cette analyse. Toutes sont en effet articulées autour de deux éléments, l'un dit élément contextuel, l'autre dit élément individuel. La systématisation des infractions à travers ces deux composantes est concluante. Elle permet d'identifier des critères de définition permettant de couvrir l'ensemble des crimes considérés, de les réunir en une notion unitaire et ainsi de révéler toute l'originalité du comportement sanctionné par la notion d'infraction internationale par nature.

Le caractère collectif distingue la criminalité internationale des infractions de droit commun. Le droit prend en compte cette réalité en adaptant la définition des formes de participation criminelle punissables et en retenant une théorie spécifique de la culpabilité. Ces évolutions participent à la convergence du droit des crimes contre l'humanité et du droit des crimes de guerre et à la précision du droit des infractions internationales.

L’actualité regorge malheureusement d’exemples de crimes contre l’humanité, de génocides, d’actes de piraterie maritime, de prises d’otages et autres crimes de terrorisme international, à travers le monde. Ces crimes sont souvent englobés sous le qualificatif de « crimes internationaux » alors même qu’ils correspondent à des actes et à des régimes juridiques très différents. L’objectif de cet ouvrage est d’analyser les interactions normatives entre droit international et droits pénaux étatiques afin de démontrer que coexistent deux processus normatifs différents - l’internationalisation du droit pénal interne et la pénalisation du droit international. Ces processus ont donné naissance à deux corpus de droit relevant d’ordres juridiques différents : – le droit pénal international réglementant les crimes transnationaux (dont la piraterie maritime, le détournement d’avion, le financement du terrorisme ou encore la corruption internationale) – le droit international pénal encadrant les crimes supranationaux (limités pour l’heure au crime d’agression, au génocide, au crime contre l’humanité et aux crimes de guerre les plus graves). Les premiers sont dits transnationaux car dépassant les frontières étatiques, ils ont fait l’objet de conventions internationales de coopération pénale visant à renforcer l’efficacité de leur prévention et répression. Ils demeurent néanmoins des crimes de droit commun incriminés par les droits pénaux internes et jugés par les seules juridictions nationales. Les seconds sont qualifiés de supranationaux parce qu’ils constituent des violations graves de normes fondamentales du droit international et sont directement encadrés par le droit international, indépendamment des droits pénaux nationaux. Leur régime juridique présente des spécificités propres, à commencer par la compétence de juridictions pénales internationales pour en juger. L’originalité ici sera d’étudier ensemble ces deux aspects, de présenter les régimes juridiques associés à chaque type de crimes internationaux et d’étudier les évolutions de la société internationale tout à la fois qu’ils expliquent et auxquelles ils donnent lieu.
