Le patrimoine commun de l'humanité se présente comme une notion juridique à portée limitée. Issue d'une genèse, conflictuelle cette notion ne s'applique aujourd'hui explicitement qu'à des domaines restreints. Même dans ces cas le régime juridique de cette notion demeure hétérogène et ambigu. Pourtant, potentiellement, le patrimoine commun de l'humanité recèle des éléments novateurs comme la reconnaissance de la primauté de l'humanité ou la nécessité d'une gestion rationnelle des ressources commune qui sont susceptibles de contribuer à l'amorce d'une alternative à la vision économique réductrice dominante. Devant les grands problèmes contemporains, toute une partie de la doctrine et de la société mondiale plaide pour la recherche d'un nouvel ordre de l'humanité qui permette la protection et l'épanouissement des hommes et de la nature. Les prémices d'une gestion protectionniste et même prospective de certains espaces sont apparus en Australie, lors de la mise en œuvre de la convention du patrimoine mondial de l'Unesco. Ils préfigurent la possibilité de "rencontres" culturelles et s'engagent dans la voie d'un développement écologiquement durable. Le domaine de l'environnement constitue, en effet, le pole principal d'extension de la notion revendiquée par la doctrine. Cependant, le contexte idéologique défavorable, sans avoir totalement évacué cette notion s'est employé à la vider de sa substance la plus novatrice.
