Surgida con tardanza si se compara el momento de su aparición con el de muchas otras figuras, ha de considerársela natural e indispensable para el desenvolvimiento y la consolidación de las relaciones jurídicas. Empleado el vocablo habitualmente, tanto para indicar el fenómeno extintivo de derechos, pretensiones, relaciones, que por previsión normativa ocurre en razón del transcurso de un determinado tiempo sin la actividad debida por parte del titular, ni reconocimiento de parte del obligado (prescripción extintiva), como para señalar la adquisición de un derecho real, a título originario, por su ejercicio continuado durante determinado tiempo, la tendencia actual se orienta a circunscribir el empleo del vocablo prescripción para indicar el fenómeno extintivo y designar con el nombre de usucapión al resultado adquisitivo.
