Los antecedentes del principio de presuncion de inocencia se encuentran en el Derecho Romano. Desde entonces tiene como objetivo evitar los juicios condenatorios anticipados en contra del inculpado, sin una consideracion detenida en la prueba de los hechos. Lo expresado obliga a determinar la responsabilidad a traves de una sentencia fundada, congruente y acorde a las fuentes del derecho vigente. La legislacion cubana lo reconoce como un derecho que tiene todo acusado a que se le presuma inocente hasta que exista una sentencia que afirme o niegue su culpabilidad. Sin embargo, la Ley de Enjuiciamiento regula diversos actos en los cuales el juez en el desempeno de sus funciones adopta criterios cuyo pronunciamiento se parcializa con la parte acusadora. Con su actuar se quebranta el derecho del acusado a la presuncion de inocencia. La norma legal lo favorece, al obligarlo en unos casos, y en otros, otorgarle facultades que le permiten proceder segun su valoracion. Lo anterior refleja la contradiccion existente entre lo regulado por la ley y los principios que sustentan el proceso penal."
