Este seminario fue realizado bajo los auspicios del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR), del Comité Internacional de la Cruz Roja (CICR), de la Comisión Internacional de Juristas (CIJ) y de la Comisión Andina de Juristas (CAJ). El seminario tuvo cuatro sesiones, cada una con un tema principal. El tema de la primera sesión estuvo relacionado con los derechos humanos y los sistemas de protección al nivel universal como al nivel regional. La segunda sesión fue dedicada al derecho internacional humanitario como sistema de protección de la persona humana. La tercera sesión fue reservada al tema del refugiado. Las ponencias desarrolladas presentaron la cuestión de las cláusulas de cesación y de exclusión del estatuto de refugiado, de la relación entre el asilo y el refugio, de la evolución del concepto de refugiado, de su definición según la Convención de 1951. La cuarta sesión discutió del problema de los indocumentados en el marco de las exigencias del orden público, de su caracterización migratoria y de la convergencia de derecho internacional aplicable.

La mayor parte del trabajo efectúa análisis teniendo presente el derecho internacional, en muchas partes del escrito también se alude al derecho global y, en ocasiones, al interno. A pesar de las enormes diferencias de naturaleza, procesos de producción normativa, aplicación coactiva y otras divergencias entre estos ordenamientos normativos (algunos incluso le niegan carácter de derecho al derecho global)19, creo que es factible referirme a ellos, dado el carácter general y teórico de las partes del escrito donde se incurre en esta fórmula, que versan sobre los fundamentos de la protección de los derechos humanos frente a los actores no estatales por medio de normas que el derecho internacional y el global tienen un ámbito de aplicación y un proceso de creación que escapa a las fronteras estatales, aunque se señalarán divergencias e incompatibilidades cuando sea pertinente.
