In Italia, i crimini di guerra rimangono un tema raramente affrontato da studiosi, avvocati e magistrati, come anche dal Parlamento, nonostante il fatto che una più completa repressione di tali crimini può aversi solamente quando alle norme di diritto internazionale sono affiancate norme di diritto interno, e soprattutto qualora gli strumenti interni siano effettivamente adeguati a realizzare la repressione richiesta dagli obblighi internazionali. Il volume si propone in primo luogo di identificare quali siano i crimini di guerra consolidatisi nel diritto internazionale consuetudinario e, più recentemente, in quello pattizio e di analizzare le modalità con cui l¿ordinamento italiano si sia adattato agli obblighi internazionali in questo campo. La prima parte del libro tratteggia dunque alcuni temi di carattere generale che possano contribuire ad una più agevole comprensione della "parte speciale", anche tramite riferimenti alla normativa italiana, rilevante per comprendere gli obblighi assunti sia dal legislatore costituente italiano che in sede di autorizzazione alla ratifica di determinati trattati.Una particolare attenzione e' posta sul lento e difficoltoso processo di adattamento al diritto internazionale dei crimini di guerra da parte del Parlamento e sul ruolo che i magistrati potrebbero svolgere in questo ambito. La seconda parte del libro si occupa invece dell'analisi delle singole fattispecie, dei loro elementi e di come esse siano state interpretate e applicate dai giudici internazionali (e, in talune istanze, anche nazionali) al fine di comprenderne le origini e tratteggiarne i caratteri essenziali. Al termine di ogni capitolo viene presentato lo stato del diritto in Italia, come risulta dalla legislazione vigente e dalla giurisprudenza dei nostri tribunali.

This book provides an essential and critical overview of the most significant issues concerning the domestication of international criminal law, in particular with regard to the implementation of the ICC Statute. It discusses the most recent proposals for reform of the German Code of Crimes under International Law, the "Völkerstrafgesetzbuch", 20 years after its entering into force and introduces the project for an Italian code of international crimes drafted by the Committee of experts established in 2022 by the Ministry of Justice. Following the adoption of the ICC Statute, many States, including Germany with the "Völkerstrafgesetzbuch", introduced specific legislation to incorporate international criminal law into their domestic legal systems and a considerable number of them have been investigating and prosecuting war crimes, crimes against humanity, genocide, and even aggression ever since. Twenty-five years later, however, the process is not completed as other countries, like Italy, are still working on adopting provisions on international crimes. This book opens with a broad overview of the different approaches of the domestication of international criminal law, with a specific focus on the German and the Italian systems. After an assessment of the prerequisites for the domestic implementation of international criminal law, also from a constitutional law perspective, each chapter offers an in-depth analysis of a specific issue, such as: the definition of international crimes (genocide and crimes against humanity, war crimes and aggression); the applicability of and exceptions to the general principles of domestic criminal law; the regulation of individual criminal responsibility; sanctions and sentencing; as well as procedural aspects related to immunities, jurisdiction and prosecutorial discretion. The strong academic perspective of many authors is complemented by an equally strong practitioner perspective of the others, provided by legal scholars in the highest positions in international and national judicial institutions, resulting in a well-informed and critical appraisal of the most recent developments overall in the international criminal justice system. Domesticating International Criminal Law will be of great interest to legal scholars and students, as well as practitioners with an interest in comparative and international law, international criminal law and international relations.

Crimini di guerra sono stati perpetrati in Italia fin dall'Unità con la repressione del brigantaggio e altri sono stati commessi da italiani già a partire dalle spedizioni coloniali in Africa Orientale e in Libia. Ma è soprattutto durante il ventennio fascista che l'Italia si rende responsabile della violazione dei più elementari diritti umani nelle guerre in Etiopia, Somalia, Spagna e – ancor più – nel corso della seconda guerra mondiale. In particolare, tra il 1940 e il 1943, insieme alla Germania, è protagonista di numerosi eccidi di civili in Jugoslavia, Grecia, Albania, ma anche in Russia e in Francia. Poi, tra il 1943 e il 1945, il nostro paese subisce stragi efferate a opera dei nazisti, sostenuti dai fascisti della Repubblica di Salò. Per questo motivo, l'Italia viene a trovarsi nella particolare situazione di essere considerata responsabile e vittima di crimini di guerra al punto da impedirle, nei decenni successivi, di riconoscere tanto le responsabilità dei propri soldati in Africa Orientale e soprattutto nei Balcani, così come di perseguire i nazifascisti colpevoli delle stragi compiute sul suo territorio. Questa vera e propria strategia politica di occultamento ha subito un parziale ripensamento solo dopo la fine della guerra fredda. Dal 2005 a oggi sono state emesse numerose sentenze che hanno contribuito a rinnovare il rapporto tra storia e memoria su una delle questioni più tragiche e controverse della storia nazionale.
